Granting
Law Enforcement Capacity to Employees of the Dubai
Creative
Clusters Authority[1]

The
Director General of the Dubai Creative Clusters Authority,
After perusal of:
Law No. (15)
of 2014 Concerning Creative Clusters in the Emirate of Dubai;
Law No. (32) of
2015 Concerning the Official Gazette of the Government of Dubai;
Law No. (8) of
2016 Regulating the Grant of Law Enforcement Capacity in the Government of
Dubai; and
The legislation
regulating commercial companies and corporations, activities, and business
within Creative Clusters in the Emirate of Dubai,
Does hereby
issue this Resolution.
The Employees of the Dubai
Creative Clusters Authority (the "DCCA"), whose names and designations
are set out in the Schedule attached hereto, are
hereby granted
law enforcement capacity to record the acts committed in breach of the
legislation regulating commercial companies and corporations, activities, and
business within Creative Clusters in the Emirate of Dubai.
The employees who are granted law
enforcement capacity pursuant to Article (1) of this Resolution must:
1.
comply
with the legislation regulating commercial companies and corporations,
activities, and business within Creative Clusters in the Emirate of Dubai, and
with the procedures stipulated therein, when performing their duties;
2.
ensure
that the Persons to whom the legislation regulating commercial companies and
corporations, activities, and business within Creative Clusters in the Emirate
of Dubai applies are in compliance with the provisions thereof, and that they meet their
obligations thereunder;
3.
record the violations they are
assigned to investigate and collect relevant evidence and information in
accordance with the rules approved in this regard;
4.
receive
reports and complaints relating to the violations that they are assigned to record in accordance with the
procedures approved by the DCCA in this regard;
5.
take
the procedures and measures required to preserve the evidence relevant to any committed violation;
6.
prepare
fact-finding reports in which the relevant incidents and
the measures
taken by them are stated;
7.
adopt
professional integrity and honesty, impartiality, and objectivity;
8.
produce
evidence of having law enforcement capacity when performing their duties; and
9.
not
use their law enforcement capacity to achieve personal goals or benefits.
The employees who are granted law
enforcement capacity pursuant to Article (1) of this Resolution will have the
duties and powers to:
1.
where
required, seek assistance from police personnel;
2.
where
required, seek assistance from experts and translators;
3.
hear
and record the statements of reporting persons and witnesses; and
4.
perform inspection, conduct interrogations,
request
clarifications, and access authorised places to collect information related to committed violations.
The Deputy
Director General
of the DCCA will take the actions required for the
implementation of the provisions of this Resolution, including to:
1.
issue
identification cards to the law enforcement officers to whom
Article (1) of this Resolution applies; and
2.
approve
violation report forms, including their basic details, in accordance with the
above-mentioned Law No. (8) of 2016.
This Resolution comes into force on the
day on which it is issued, and will be published in the Official Gazette.
