Establishing the

Dubai Youth Council[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,

After perusal of:

Cabinet Resolution No. (40/2W/6) Establishing the Emirates Youth Council, issued at Session No. (2) held on 28 February 2016;

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Decree No. (28) of 2015 Concerning Governance of the Boards and Committees Affiliated to the Government of Dubai; and

Executive Council Resolution No. (40) of 2015 Concerning the Functions of the General Secretariat of the Executive Council of the Emirate of Dubai,

Do hereby issue this Resolution.

Definitions

Article (1)

The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise:

Emirate:

The Emirate of Dubai.

Executive Council:

The Executive Council of the Emirate of Dubai.

General Secretariat:

The general secretariat of the Executive Council.

EYC:

The council established pursuant to the above-mentioned Cabinet Resolution No. (40/2W/6).

DYC:

The Dubai Youth Council established pursuant to this Resolution.

Youth:

Community members who are between fifteen (15) and thirty (30) years of age.

Chairman:

The chairman of the DYC.        

Member:

A member of the DYC.

Rapporteur:

The rapporteur of the DYC.

 

Establishment of the DYC

Article (2)

Pursuant to this Resolution, a council named the “Dubai Youth Council” is established. The DYC will be affiliated to the Executive Council.

Objectives of the DYC

Article (3)

The DYC will have the following objectives:

1.      to ensure consistency between the Federal Government vision and the EYC plans in matters related to the Youth causes;

2.     to create a platform for communication between the Youth and the government and private entities in the Emirate, and with the EYC;

3.     to communicate with the Youth in the Emirate to explore the most important topics related to their ambitions and future plans, and identify the major challenges they face;

4.     to adopt and develop initiatives and projects related to the Youth in the Emirate, and to encourage them to engage in the process of follow-up and coordination between the DYC and the concerned entities to implement these initiatives and projects;

5.     to promote the role of the Youth and raise their awareness of the needs of their community;

6.     to strengthen the cultural and social ties amongst the Youth; and

7.     to encourage the talented and innovative Youth and adopt and support their innovations.

Functions of the DYC

Article (4)

For the purpose of achieving its objectives, the DYC will have the duties and powers to:

1.      cooperate with the concerned government entities in developing an Emirate-wide national Youth strategy, in accordance with the federal Youth strategy and in coordination with the EYC;

2.     coordinate with the EYC to implement joint initiatives and hold joint events;

3.     establish frameworks for cooperation and coordination amongst the entities concerned with the affairs and causes of the Youth, and establish effective communication between these entities and the DYC;

4.     propose the initiatives, events, and activities that are relevant to the development of the Youth in all social, educational, economic, professional, sports, and other fields; submit these initiatives, events, and activities to the EYC for approval then present them to the Executive Council for final approval; and supervise the implementation of the same;

5.     communicate with the Youth of the Emirate to inform them on the visions, plans, and initiatives of the entities concerned with Youth development;

6.     prepare an annual agenda of the initiatives, events, and activities related to the Youth of the Emirate; and develop the required plans and programmes and implement the media campaigns required for informing the Youth of these initiatives, events, and activities;

7.     disseminate successful Youth experiences within and outside of the Emirate, and set the appropriate procedures for benefiting from these experiences;

8.     forge partnerships with the public and private sectors to support the Youth and to enable the DYC to achieve its objectives; and

9.     perform any other duties required for the achievement of its objectives, as assigned to it by the Chairman of the Executive Council.

Formation of the DYC

Article (5)

Pursuant to a resolution issued by the Chairman of the Executive Council, the DYC will be formed of sixteen (16) members, including the Chairman and vice chairman. The term of membership in the DYC will be three (3) years, renewable for the same period.

Membership Requirements

Article (6)

 To be appointed as a Chairman or a Member, a person must:

1.      be a UAE national and hold a family book (Khulasat Qaid) issued by the Emirate;

2.     be of good conduct and repute;

3.     not be less than twenty-one (21) nor more than thirty (30) years of age;

4.     be a student enrolled in an educational institution, an employee in either the public sector or the private sector, or an entrepreneur; or be active in volunteer or civil society work; and

5.     have demonstrated distinguished and leading personality in any of the fields related to the Youth causes.

Periodic Reports

Article (7)

The DYC will, through the General Secretariat, submit to the Chairman of the Executive Council periodic reports on the outcomes of the DYC work, activities, and events; on the obstacles encountered by it; on the solutions and proposals recommended by it; and on the cooperation level between the DYC and the EYC and other entities concerned with the affairs of the Youth.

Formation of Work Teams

Article (8)

The DYC may form specialised work teams, from amongst its Members or other persons, to assist it in performing its duties. Each of these work teams must include at least one Member.

Meetings of the DYC

Article (9)

a.     The DYC will convene at the invitation of the Chairman, or vice chairman where the Chairman is absent, at the time and place he determines. The DYC must hold at least six (6) meetings a year.

b.     DYC meetings will be valid if attended by the majority of its members, provided that the Chairman or vice chairman is in attendance.

c.     The DYC will pass its resolutions and recommendations by majority vote of attending members; and in the event of a tie, the chair of the meeting will have a casting vote.

d.     Where a Member objects to any of the decisions or recommendations of the DYC, this Member may record his objection in writing in the minutes of the relevant DYC meeting or in a separate written document.

Minutes of DYC Meetings

Article (10)

The discussions, resolutions, and recommendations of the DYC will be recorded in minutes of meetings. These minutes will be sent to the chair of the meeting and attending members for their comments or approval. The minutes of meetings will be considered final if the chair of the meeting and the attending members do not object to their contents, or request their correction, within seven (7) days from the date of sending these minutes.

Duties of the Chairman

Article (11)

The Chairman will have the duties and powers to:

1.      submit to the Chairman of the EYC quarterly reports on the events and initiatives implemented across the Emirate;

2.     extend invitations to DYC ordinary and extraordinary meetings, and approve meeting agendas;

3.     manage DYC meetings in a manner that ensures effective contribution of the Members through providing their opinions, suggestions, and recommendations on matters referred to them;

4.     supervise performance by the Members of their duties, and ensure effective communication between them and the Youth;

5.     assign to Members any work that supports the DYC in performing its duties and achieving its objectives;

6.     periodically assess the performance of Members and of the work teams formed within the DYC;

7.     prepare the draft annual budget of the DYC, and refer the same to the General Secretariat to take the necessary action for its approval by the competent entities in the Emirate; and

8.     perform any other duties that are relevant to the Youth and are required for the achievement of the objectives of the DYC.

Duties of Members

Article (12)

A Member must:

1.      submit proposals and initiatives; and effectively participate in considering and discussing the recommendations, proposals, initiatives, plans, and other matters referred to the DYC;

2.     give objective and impartial opinions on the matters referred to the DYC;

3.     attend all DYC meetings unless he has obtained a prior permission or has a valid reason to be absent. Where a DYC member fails to attend more than three (3) consecutive meetings without a valid reason, or is absent for five (5) non-consecutive meetings within a year, the Chairman must submit, through the General Secretariat, a report on the case to the Chairman of the Executive Council to make the appropriate decision in this regard; and

4.     submit periodic reports to the Chairman on the duties assigned to him by the Chairman or the DYC.

Rapporteur

Article (13)

a.     A Rapporteur will be appointed to the DYC by the Chairman.

b.     The Rapporteur will have the duties to:

1.      prepare the DYC meeting agendas and obtain the Chairman's approval of the same; and send these agendas, together with meeting invitations, to Members;

2.     record minutes of meetings and follow up their approval by the Chairman and attending Members;

3.     verify that the required quorum is present at DYC meetings and inform the Chairman of the same;

4.     follow up implementation of the administrative directives issued to him by the Chairman in relation to the work of the DYC;

5.     follow up implementation of the resolutions and recommendations issued by the DYC;

6.     document and organise the minutes of meetings of the DYC, and organise its records and documents;

7.     provide all the administrative support required for the performance by the DYC of its duties; and

8.     perform any other duties that are relevant to the functions of the DYC, as assigned to him by the Chairman.

Confidentiality

Article (14)

a.     The Chairman and Members must not, during or after their term of membership in the DYC, disclose or divulge any written or verbal information which is confidential in nature or pursuant to legislation in force, unless they obtain a prior relevant permission from the entity that owns this information. They must not, in particular:

1.      copy, retrieve, transfer, or disclose any information, facts, or documents to which they have access in the course of their duties;

2.     use the information to which they have access in the course of their duties for unauthorised purposes;

3.     misuse the information they obtain as a result of their membership in the DYC; or

4.     allow any unauthorised person to access information or documents related to their work.

b.     Upon forfeiture, termination, or expiry of membership of the Chairman or a Member, he must return all documents, papers, files, material, tapes, discs, software, or any other DYC property in his possession, whether or not these include confidential information.

c.     For the purpose of implementing the provisions of this Article, the Chairman, Members, and Rapporteur must sign the relevant confidentiality and non-disclosure undertaking in the form prescribed by the General Secretariat for this purpose.

Governance of the DYC

Article (15)

The provisions of the above-mentioned Decree No. (28) of 2015 and the resolutions issued in pursuance thereof will apply to the DYC.

Administrative and Technical Support

Article (16)

The General Secretariat will provide all administrative and technical support to the DYC to enable it to achieve its objectives and perform the duties assigned to it pursuant to this Resolution.

Cooperation with the DYC

Article (17)

All government entities must cooperate with the DYC to enable it to perform the duties assigned to it pursuant to this Resolution; and to develop and implement the initiatives, events, and activities that are relevant to the Youth of the Emirate.

Commencement and Publication

Article (18)

This Resolution comes into force on the day on which it is issued, and will be published in the Official Gazette.
