Administrative Resolution No. (11) of 2016

Concerning the

Jurisdiction of the Centre for Amicable Settlement of Disputes[1]

The President of the Dubai Courts,

After perusal of:

Law No. (6) of 2005 Regulating the Dubai Courts and its amendments;

Law No. (16) of 2009 Establishing the Centre for Amicable Settlement of Disputes (the “CASD”);

Executive Council Resolution No. (23) of 2010 Establishing a New Organisational Unit within the Dubai Courts;

Resolution No. (9) of 2011;

Resolution No. (20) of 2012 issued by the President of the Dubai Courts in respect of the CASD jurisdiction;

The recommendation issued and noted in the minutes of meeting of the Supreme Judicial Affairs Committee no. (01- 2016), and the presentations submitted to the President of the Dubai Courts,

Does hereby issue this Resolution.

Article (1)

The CASD will have jurisdiction over:

1.    disputes related to the subdivision of co-owned property;

2.    disputes where the debt principal does not exceed one hundred thousand Dirhams (AED 100,000.00);

3.    disputes referred to it upon the request of either or both disputants at the time of registration;

4.    disputes referred to it upon the request of both parties to a claim, regardless of its value, that is being heard by a first instance, commercial, civil, or real estate court, subject to the approval of the head of the competent court division;

5.    disputes where one of the parties is a bank; and

6.    applications to assign or appoint an expert, whether the application is filed separately or in conjunction with any other application.

Article (2)

Notwithstanding Article (1) of this Resolution, the CASD will have no jurisdiction over the following:

a.    labour disputes; and

b.    disputes related to family affairs.

Article (3)

Any previous resolutions contradicting the provisions of this Resolution are hereby repealed.

Article (4)

Concerned entities must take all necessary actions and follow up the implementation of this Resolution as of 1 March 2016.
