Council Resolution No. (40) of 2015
Concerning
the Functions of the General Secretariat of the
Executive
Council of the Emirate of Dubai[1]

We,
Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of
the Executive Council,
After perusal of:
Law No. (3) of 2003 Establishing the Executive Council of
the Emirate of Dubai;
Decree No. (25) of 2008 Appointing Two Deputies to the
Chairman of the Executive Council;
Regulation No. (3) of 2006 Approving the Duties of the General Secretariat and the Secretary General of the
Executive Council of the Emirate of Dubai;
Executive Council Resolution No. (10) of 2009 Approving the
Government Communications General Guide for the Departments, Authorities, and
Public Corporations Affiliated to the Government of Dubai;
Executive Council Resolution No. (26) of 2009 Establishing
the Sectoral Committees of the Executive Council and its amendments;
Executive Council Resolution No. (27) of 2009 Approving the
Statute of the Sectoral Committees of the Executive Council;
Executive Council Resolution No. (7) of 2010 Approving the
Dubai Strategic Plan Implementation Management System; and
Executive Council Resolution No. (46) of 2013 Concerning
the Budget of Strategic Programmes of Government Entities in the Emirate of
Dubai,
Do hereby issue this Resolution.
The following words and expressions, wherever
mentioned in this Resolution, will have the meaning indicated opposite each of
them unless the context implies otherwise:
Emirate: |
The Emirate of Dubai. |
Government: |
The Government of Dubai. |
Executive Council: |
The Executive Council of the Emirate of
Dubai. |
Chairman: |
The Chairman of the Executive Council. |
Government Entity: |
Any of the Government departments;
public agencies and corporations; councils, free zone authorities, Special
Development Zone authorities, and similar entities. |
General Secretariat: |
The general secretariat of the Executive
Council. |
Secretary General: |
The secretary general of the Executive
Council. |
The General Secretariat will support the
Executive Council in establishing, adopting, and administering the policies and
strategies of the Emirate; and in monitoring and following up the
implementation of these policies and strategies by Government
Entities. For this purpose, the General Secretariat will:
1.
support
the Executive Council in adopting and implementing the strategic decisions
and orientations of the Emirate;
2.
lead
the process of preparing and updating the Dubai Strategic Plan, and provide
technical support to develop the strategies of various sectors;
3.
formulate
the future orientations and work priorities of the Emirate and ensure their alignment with the
orientations adopted at the federal level; and propose and implement, in coordination with competent
Government Entities, joint
frameworks and work systems
in order to promote Government performance in the Emirate;
4.
follow
up the implementation of the Dubai Strategic Plan, the sectoral plans, and the policies, initiatives, and programmes approved
by the Executive Council, through the Dubai Strategic Plan
Implementation Management System, which includes performance indicators and Strategic
Programme
indicators; and submit the
relevant periodic reports to the Executive Council;
5.
manage
the programmes that aim at achieving excellence and leadership in Government
operations, develop Government performance, and instil the culture of
excellence and creativity of government work in accordance with the relevant
standards, models, and best practices; and submit the relevant reports to the
Executive Council;
6.
manage
the programmes that aim at developing public services and promoting them to the highest levels of excellence, and take the lead in
improving the level and quality of these services and their delivery channels, in
accordance with the relevant manuals, standards, models, and best practices;
and submit the relevant reports to the Executive Council;
7.
provide
consultations and proposals to the Executive Council on
methods of developing and improving the efficiency and competence of the
Government apparatus;
8.
prepare
and review the general Government structure,
including the working methods of the Government;
propose the modifications required
to develop this
structure in accordance with the principles of good governance;
support and develop the process of approving the organisational structures of
Government Entities; and support the establishment of new
Government Entities;
9.
review
the policies and strategies proposed by Government Entities prior to their
presentation to the Executive Council and its Sectoral Committees;
10. manage and monitor the key performance
indicators of Government Entities and ensure they are aligned with the approved
strategic plans; and submit the relevant reports to the Executive Council;
11. ensure that Government resource management
policies, including financial, human, and technological resource management policies, are aligned with the strategic orientations and
priorities of the Emirate;
12. implement and administer Government
communications policies at the levels
of the Executive Council, its
Sectoral Committees, and Government Entities, including the policies related to
the corporate identity of Government Entities, in accordance with the relevant
approved policies and manuals and
in a manner that ensures engaging various segments of the community in
formulating Government policies
and plans;
13. devise, and follow up the implementation of, a
general framework for the management and transfer of knowledge and innovation
in the Government sector
in a manner that ensures the
exchange of skills and implementation of best international practices of government
work;
14. conduct research and studies on matters
referred to it by the Executive Council and its Sectoral Committees, and provide relevant proposals and recommendations with respect to
these matters;
15. coordinate the efforts of
Government Entities to ensure the proper
conduct of their work;
16. provide administrative and technical support to
the Executive Council and its Sectoral Committees and sub-committees, including
coordinating meetings; preparing and documenting resolutions and
recommendations, and following up implementation of the same in coordination
with concerned entities; and
17. perform any other duties assigned to it by the
Chairman or his two Deputies.
The Secretary General will supervise the work
of the General Secretariat, manage its affairs, and issue the resolutions
required for regulating its work. For these purposes, he will have the
authority to:
1.
supervise
the conduct of studies and research on the initiatives and projects which are
commissioned by the Chairman or his two deputies, or by the Executive Council;
2.
supervise
the documentation of the resolutions and recommendations issued
by the Executive Council;
3.
follow
up the implementation of the resolutions and recommendations
issued by the Executive Council and its Sectoral Committees; prepare the
relevant required reports; and submit these reports to
the Executive Council;
4.
prepare
the meeting agendas of the Executive Council in coordination with the concerned
Government Entities;
5.
approve
the minutes of meetings of the Executive Council and notify its members of its
activities and the dates and times of its meetings;
6.
approve
the work manual of the Executive Council and its Sectoral Committees in
coordination with the concerned Government Entities;
7.
supervise the
preparation of the strategic plan and operational plans of the General
Secretariat, and follow up their implementation;
8.
supervise the
preparation of the annual budget of the General Secretariat, and follow up its
implementation;
9.
supervise
the executive body of the General Secretariat; and
appoint, and determine the salaries and benefits of, its employees, in
accordance with the relevant approved regulations;
10. represent the General Secretariat before third
parties and sign, in its name and on its behalf,
contracts, agreements, and memoranda of understanding in areas related to the
work of the General Secretariat;
11. open and manage accounts with banking
institutions operating in the UAE; and
12. perform any other duties assigned to him by the
Chairman, his two deputies, or the Executive Council.
a.
The
General Secretariat will have an organisational structure that reflects its functions. This organisational structure must be
approved pursuant to a resolution of the Secretary General.
b. The Secretary General will have one or more
assistants appointed pursuant to a resolution of the Secretary General.
The General Secretariat will have its own
regulations and bylaws,
which govern the conduct of its
work, including human resource regulations, procurement and
contracts regulations, and financial regulations. Each of these bylaws and
regulations will be approved pursuant to a resolution of the Secretary General.
For the purpose of performing its functions,
the General Secretariat may, as it deems appropriate, seek assistance from
specialised experts, consultants, and valuators from within or outside of the Emirate.
The relationship between the General Secretariat and these
experts, consultants, and valuators will be regulated in accordance with the
relevant regulation approved by the Secretary General.
The General Secretariat will have an annual
budget incorporated in the general budget of the Government.
a.
In managing its accounts and records, the General Secretariat will
apply the rules and principles of government accounting approved in this
respect.
b. The financial year of the General Secretariat
will commence on 1 January and will end on 31 December of each year.
Government Entities must cooperate with the
General Secretariat and provide it with all the documents, data, information,
statistics, and studies it requires and deems necessary to perform its functions
under this Resolution.
The Secretary General will issue the
resolutions required for the implementation of this Resolution.
The above-mentioned Regulation No. (3) of 2006
is hereby repealed. Any provision in any other resolution will also be repealed
to the extent that it contradicts the provisions of this Resolution.
This Resolution comes into force on the day on
which it is issued, and will be published in the Official Gazette.
