Amending the Schedule of Public Hygiene-related Violations and Penalties

Attached to the Implementing Bylaw of Local Order No. (11) of 2003

Concerning Public Health and Community Safety in the Emirate of Dubai^{^[1]}

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,

After perusal of:

The Order of 1961 Establishing the Dubai Municipal Council;

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Law No. (35) of 2009 Concerning Management of the Public Funds of the Government of Dubai and its amendments;

Local Order No. (7) of 2002 Concerning Waste Disposal Sites in the Emirate of Dubai and its amendments;

Local Order No. (11) of 2003 Concerning Public Health and Community Safety in the Emirate of Dubai and its amendments; and

Administrative Resolution No. (30) of 2007 Issuing the Implementing Bylaw of Local Order No. (11) of 2003 Concerning Public Health and Community Safety in the Emirate of Dubai and its amendments,

Do hereby issue this Resolution.

Amendment of the Violations and Penalties Schedule

Article (1)

The Schedule of Public Hygiene-related Violations and Penalties attached to the above-mentioned Administrative Resolution No. (30) of 2007 is hereby superseded by the Schedule attached to this Resolution.

Repeals

Article (2)

Any provision in any other resolution will be repealed to the extent that it contradicts the provisions of this Resolution.

Publication and Commencement

Article (3)

This Resolution will be published in the Official Gazette and will come into force on the day on which it is published.

6	Dropping or disposing of Waste or hazardous materials in other than the sites designated for this purpose	5,000.00
7	Disposing, in other than the approved disposal sites, of construction or demolition debris or residues of technical or production processes of companies, factories, or establishments	5,000.00
8	Disposing of Wastewater, by any means, in open spaces or in other than the sites designated by the Competent Directorate for this purpose	100,000.00
9	Failure to take the necessary action to prevent the leakage or overflow of Wastewater from Buildings, or its flow from vacuum tankers on public roads	10,000.00
10	Dropping solid materials, or spilling fluid materials, from a ready-mix concrete delivery vehicle travelling on a public road; or disposing of such materials in other than the sites designated for this purpose	50,000.00

19	Leaving any vehicle or equipment unattended in a Public Place in a manner that adversely affects public health and safety, or the environment	AED 500.00, and impoundment of the vehicle or equipment upon expiry of the prescribed notice period
20	Failure to designate a room or other facility within a Building for maintaining Waste collection and storage containers in accordance with the conditions and specifications determined by the Competent Directorate	5,000.00
21	Failure to provide Waste storage containers within a Building, failure to take out these containers and return them back to their original locations immediately upon being emptied or as prescribed by the relevant directives, or failure to perform the maintenance required for Waste storage containers	500.00
22	Failure to clean or manage a Building in accordance with the public health and environment protection rules	1,000.00
23	Failure by a private company or corporation, a mall, a residential or industrial complex, or a hotel establishment to provide containers for storage of the Waste resulting from its activities in accordance with the relevant requirements, conditions, and standards adopted by the Competent Directorate	5,000.00
24	Failure to comply with the instructions of the Competent Directorate to replace Waste containers where the amount of Waste resulting from the conduct of the activity of an entity exceeds the capacity of existing Waste containers, or where the resulting Waste poses a danger to public health	1,000.00
25	Failure to implement a cleaning plan for outdoor private and public parking areas serving an entity, failure to provide appropriate Waste collection containers in these parking areas, or failure to make the necessary arrangements for emptying such containers on a daily basis	500.00
26	Collecting, storing, transporting, reusing, recycling, or treating any Waste produced by third parties; or providing cleaning services in Public Places without first obtaining a permit from the Competent Directorate and satisfying the relevant standards and conditions set by this directorate	5,000.00
27	Putting into a Waste container any materials that may cause damage to that container or to the Waste transport vehicle; or pose a danger to the health and safety of persons collecting, transporting, and disposing of Waste	1,000.00
28	Displacing, or changing the place of, a Dubai Municipality's Waste container without the approval of the Competent Directorate	200
29	Scavenging or picking up recyclable or other Waste materials from a Dubai Municipality's Waste container	1,000.00
30	Causing damage to a Waste container, to its enclosures, or to the solid base on which it is placed	1,000.00
31	Parking vehicles or leaving equipment or goods near a Waste container in a manner that may hinder the disposal of Waste by individuals or the emptying of containers by the Dubai Municipality's vehicles	1,000.00
32	Dumping Waste from private company-owned vehicles to the Dubai Municipality's Waste containers	1,000.00
33	Failure to develop and implement a Waste reduction or recycling plan where the Competent Directorate finds that the activity of an entity produces large amounts of Waste	1,000.00
34	Bringing in, Dealing in, obtaining, possessing, or consuming Paan, for personal use or for use by others, with or without consideration. This includes betel leaves used in preparing Paan	5,000.00
35	Making a fire or barbecuing in a Public Place where the same is not permitted by the Dubai Municipality	500.00
36	Affixing advertisements, posters, or printed material in a manner that spoils the general appearance of the Emirate	1,000.00
37	Failure by Owners of warehouses; workshops; shops selling tyres, lubricants, batteries, and other Vehicle supplies to transport the Waste resulting from their activities at their own cost to the sites designated by the Dubai Municipality	1,000.00
38	Failure to provide maintenance and cleaning services to a Waste storage room or facility in accordance with public health and environment protection rules	1,000.00
39	Dumping packages of insecticides or agrochemicals in Waste containers, or failure to dispose of the same in accordance with the instructions of the Competent Directorate	5,000.00
40	Decommissioning, or changing the use of, a Waste room in a Building or compound in a manner that prevents, in whole or in part, using it for its original purpose	5,000.00
41	Decommissioning, or changing the use of, Waste rooms in a multi-storey Building, in whole or in part	AED 1,000.00 per room
42	Failure by a pet owner to remove the pet’s waste from a Public Place	500.00
