Amending Law No. (13) of 2009

Establishing the Hamdan bin Mohammed e-University[1]

We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Law No. (27) of 2006 Concerning Management of the Government of Dubai Human Resources and its amendments; and

Law No. (13) of 2009 Establishing the Hamdan bin Mohammed e-University (the “Original Law”),

Do hereby issue this Law.

Name of the University

Article (1)

The name “Hamdan bin Mohammed e-University” will be replaced by “Hamdan bin Mohammed Smart University” wherever mentioned in the Original Law or any other legislation in force in the Emirate of Dubai.

Amended Articles

Article (2)

Articles (2), (7), (8), (11), (12), (13), (15), (16), and (22) of the Original Law will be superseded by the following:

Definitions

Article (2)

The following words and expressions, wherever mentioned in this Law, will have the meaning indicated opposite each of them unless the context implies otherwise:

UAE:

The United Arab Emirates.

Emirate:

The Emirate of Dubai.

Ruler:

His Highness the Ruler of Dubai.

HMSU:

The Hamadan bin Mohammed Smart University.

President:X

The president of the HMSU.X

Board of Governors:

The Board of Governors of the HMSU.X

Academic Council:

The Academic Council of the HMSU.X

Chancellor:

The chancellor of the HMSU.

Organisational Structure of the HMSU

Article (7)

The organisational structure of the HMSU will be comprised of:

1.       the President;

2.       the Board of Governors;

3.       the Chancellor;

4.       the Academic Council; and

5.       the vice chancellors.

Appointment and Functions of the President

Article (8)

a.       The President will be appointed pursuant to a decree of the Ruler.

b.       The President will have the duties and powers to:

1.       appoint the chairman and members of the Board of Governors;

2.       appoint the Chancellor of the HMSU; and

3.       approve the vision, strategic orientation, and general policies of the HMSU.

Functions of the Board of Governors

Article (11)

The Board of Governors will have the duties and powers to:

1.       undertake the general supervision of the management of the HMSU;

2.       approve the general policies of the HMSU and submit these to the President for final approval;

3.       approve the strategic and business plans of the of the HMSU;

4.       approve the detailed organisational structure of the HMSU;

5.       approve the bylaws regulating the work of the HMSU, including financial and administrative bylaws;

6.       approve the bylaws relating to faculty member professional affairs and to learner affairs;

7.       approve the draft annual budget and final accounts of the HMSU, and submit these to competent entities for approval;

8.       approve the requirements for awarding academic degrees and certificates and training certificates in accordance with the criteria and requirements adopted by competent entities in the UAE;

9.       assess and approve the annual report on the activities and achievements of the HMSU;

10.   establish, merge, and close colleges of the HMSU;

11.   approve tuition fees that must be collected from learners of the HMSU;

12.   appoint auditors of the HMSU, determine their remuneration, and approve their reports; and

13.   perform any other duties relating to the business and objectives of the HMSU as assigned by the President.

Functions of the Chancellor

Article (12)

a.       The Chancellor is responsible for managing the HMSU, regulating its administrative and financial affairs, and representing it before third parties. For this purpose, he will have the duties and powers to:

1.       follow up the implementation of the resolutions issued by the President and the Board of Governors;

2.       propose the general policies, strategic and business plans of the HMSU, submit these to the Board of Governors for appropriate action, and supervise their implementation upon approval;

3.       approve the annual operational plans and key performance indicators of the academic and administrative units of the HMSU;

4.       propose internal bylaws regulating work at the HMSU, including financial and administrative bylaws, and submit these to the Board of Governors for approval;

5.       propose bylaws relating to faculty member and learner affairs at the HMSU, and submit these to the Board of Governors for approval;

6.       supervise the academic and administrative staff of the HMSU;

7.       endorse decisions of the Academic Council to award academic certificates and degrees to learners of the HMSU;

8.       award training course and e-learning programme certificates;

9.       form disciplinary committees and determine their work procedures, powers, and the penalties that they may impose upon learners of the HMSU;

10.   propose the draft annual budget and final accounts of the HMSU, and submit these to the Board of Governors for approval;

11.   issue the resolutions required to ensure a proper conduct of work at the HMSU in compliance with the legislation in force in the Emirate and the bylaws and resolutions issued by the President and the Board of Governors;

12.   prepare annual reports on the affairs, achievements, activities, and conduct of work at the HMSU, and submit these to the President and the Board of Governors;

13.   enter into the contracts, agreements, and memoranda of understanding required for achieving the objectives of the HMSU; and

14.   perform any other duties assigned by the President and the Board of Governors.

b.       The Chancellor may delegate any of his powers stipulated in this Law to any of the vice chancellors provided that such delegation is specific and in writing.

Formation of the Academic Council

Article (13)

a.       The Academic Council will be formed pursuant to a resolution of the Chancellor. It will be chaired by the Chancellor with a membership of at least seven (7) members from amongst vice chancellors, faculty members, and administrative staff of the HMSU. The Chancellor will appoint from amongst them a deputy chairman.

b.       The Chancellor may invite any experts or specialists he deems appropriate to attend Academic Council meetings without the right to vote the resolutions of the Academic Council.

c.       The Chancellor will appoint, from amongst HMSU staff members, a secretary for the Academic Council who will draft minutes of meetings and maintain them in a special record signed by the Chancellor or his representative.

Functions of the Academic Council

Article (15)

The Academic Council will have the duties and powers to:

1.       propose the e-learning and scientific research policies of the HMSU;

2.       propose requirements for the award of academic degrees and certificates, and submit these to the Board of Governors for approval;

3.       approve and develop academic courses and study programmes and plans of the HMSU;

4.       encourage scientific research, approve its programmes, and assess its outcomes;

5.       approve learner admission rules, criteria, and requirements for transfer from and to the HMSU;

6.       organise and supervise the holding of HMSU examinations, and review and ratify their results;

7.       award academic degrees and certificates;

8.       approve registration of academic theses, appoint thesis supervisors, form committees for thesis defense, and cancel the registration of theses;

9.       establish, merge, or close academic departments at the colleges, institutes, or specialised centres of the HMSU;

10.   establish academic and professional societies, and grant approval for holding seminars and conferences;

11.   establish the annual academic calendar in accordance with the general framework of study;

12.   regulate academic relations with other universities and with scientific research centres;

13.   submit to the Board of Governors appropriate recommendations concerning levels of academic performance and achievements at the HMSU; and

14.   perform any other duties related to the academic affairs of the HMSU assigned by the Board of Governors.

Vice Chancellors

Article (16)

a.       The Chancellor will have one or more vice chancellors appointed pursuant to a resolution of the Board of Governors upon the recommendation of the Chancellor.

b.       A vice chancellor will assist the Chancellor in areas determined by the Chancellor.

Application of the Human Resources Management Law

Article (22)

Law No. (27) of 2006 Concerning Management of the Government of Dubai Human Resources and its amendments will apply to staff members of the HMSU other than faculty members.

Commencement and Publication

Article (3)

This Law comes into force on the day on which it is issued, and will be published in the Official Gazette.
