Regulating Work between the Government of Dubai and the

General Pension and Social Security Authority[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,

After perusal of:

Federal Law No. (6) of 1999 Establishing the General Pension and Social Security Authority;

Federal Law No. (7) of 1999 Issuing the Pension and Social Security Law and its amendments;

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Law No. (27) of 2006 Concerning Management of the Government of Dubai Human Resources and its amendments;

Law No. (32) of 2008 Establishing the Government of Dubai Legal Affairs Department;

Law No. (31) of 2009 Establishing the Dubai Government Human Resources Department; and

The Resolution of His Highness the Crown Prince of Dubai dated 14 December 2002 Concerning Subscription of all Government Departments and Public Corporations and Authorities to the Pension Schemes of the General Pension and Social Security Authority;

Do hereby issue this Resolution.

Definitions

Article (1)

The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise:

 

Government:

The Government of Dubai.

GPSSA:

The General Pension and Social Security Authority established pursuant to the above-mentioned Federal Law No. (6) of 1999.

DGHR:

The Dubai Government Human Resources Department.

Government Entities:

Government departments, public authorities and corporations, councils, authorities, Government-owned companies, and similar entities.

Insured:

A UAE national Employee working at a Government Entity to whom Law No. (7) of 1999 Issuing the Pension and Social Security Law and its amendments apply.

Functions of the DGHR

Article (2)

The DGHR will have the exclusive duty to follow up all affairs related to the persons insured by the GPSSA. For such purpose, the DGHR may, without limitation:

1.       ensure that Employees of Government Entities are enrolled in the GPSSA schemes;

2.       determine, in agreement with the GPSSA, the salary to be used for the purpose of calculating the contributions of the Insured in accordance with Government guidelines;

3.       review buyback applications to add previous service periods of the Insured to the service period adopted for calculating the retirement pension benefits or end-of-service gratuity, and refer these applications to the GPSSA, provided that the Insured bears the cost of such buyback;

4.       review the cases of the termination of the employment of the Insured and the extent to which they are entitled to retirement pension benefits, whether on the basis of completion of a prescribed period of service, old age, death, disability, or otherwise; and refer such cases to the GPSSA;

5.       provide the GPSSA with the names of beneficiaries of retirement pension benefits or end-of-service gratuity from among the family members of the Insured on the basis of the documents issued by the competent entities in this regard;

6.       review pension and social security legislation, propose any required amendments, and refer these proposals to the GPSSA through the Government of Dubai Legal Affairs Department;

7.       prepare studies related to post-retirement programmes and services;

8.       in coordination with the GPSSA, provide Government Entities with information of the Insured and retired Government Employees, as well as periodic reports and statistics; and

9.       in coordination with the Government of Dubai Legal Affairs Department, resolve and settle disputes related to contributions and entitlements of the Insured.

Obligations of Government Entities

Article (3)

Government Entities must not take any action related to the affairs of the persons insured by the GPSSA without prior coordination with the DGHR.

Publication and Commencement

Article (4)

This Resolution will be published in the Official Gazette and will come into force three (3) months after the date of its publication.
