Establishing the

Dubai Design and Fashion Council[1]

We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Law No. (1) of 2000 Concerning Dubai Technology and Media Free Zone and its amendments;

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai; and

Decree No. (22) of 2013 Annexing a Plot of Land to Dubai Technology and Media Free Zone,

Do hereby issue this Decree.

Definitions

Article (1)

The following words and expressions, wherever mentioned in this Decree, will have the meaning indicated opposite each of them unless the context implies otherwise:

State:

The United Arab Emirates.

Emirate:

The Emirate of Dubai.

Executive Council:

The Executive Council of the Emirate.

Authority:

The Dubai Technology and Media Free Zone Authority.

Council:

The Dubai Design and Fashion Council.

Formation of the Council

Article (2)

a.       By virtue of this Decree, a Council named the “Dubai Design and Fashion Council” will be established and affiliated with the Authority.

b.       The Council will be comprised of a chairman and vice-chairman and a number of members not less than five (5) including the chairman and vice-chairman. All members will be appointed by a resolution of the Chairman of the Executive Council for a renewable term of three (3) years.

The Objectives of the Council

Article (3)

The objectives of the Council are as follows:

1.    to promote the Emirate as a regional and international destination for design and fashion and to keep abreast of global developments in this field;

2.    to promote the Emirate as a leading centre for design and fashion, and to attract companies and establishments working in this field to establish a presence in the Emirate;

3.    to ensure the contribution of the design and fashion sector in achieving sustainable development in the Emirate and its positive role in promoting tourism and commerce, in accordance with the Emirate’s strategy; and

4.    to develop talented local professionals in the fashion and design industry.

Functions of the Council

Article (4)

For the purpose of achieving its objectives, the Council will have the duties and powers to:

1.    establish the general policy and approve the strategic plan for promoting the Emirate as a prominent destination for the design and fashion industry;

2.    attract local and international companies and establishments specialising in design and fashion as an effective means of commercial marketing and promotion, and focus on targeted local, regional, and international markets through creating an encouraging environment for establishments and companies working in this field;

3.    organise, deliver, and sponsor events relating to the participation of the design and fashion industry in the tourism and commercial activities in the Emirate;

4.    conduct studies and research related to the design and fashion industry and assess the extent of its economic and social impact on the Emirate;

5.    develop, attract, and train the required human resources for the design and fashion sector, especially UAE nationals, through training programmes and other means;

6.    support companies and establishments operating in the field of design related to the national heritage of the State;

7.    encourage and develop new establishments and companies operating in the design and fashion sector with a view to achieving an international status;

8.    approve the regulations, bylaws, and resolutions necessary to achieve the Council’s objectives;

9.    form the necessary committees and work teams, determine their duties and powers, and seek the assistance of experts and specialists, as it deems appropriate, to provide advice and consultation;

10.  participate in local, regional, and international design and fashion expositions and festivals; and

11.  perform any other duties related to the achievement of the objectives of the Council as stipulated in this Decree.

Meetings of the Council

Article (5)

a.       The Council will convene at the invitation of its chairman at least once every three (3) months or as necessary at such place and time to be determined by him.

b.       The vice-chairman of the Council will replace the chairman in his absence or when his post falls vacant.

c.       Council meetings will be valid if attended by the majority of the Council members, provided that the chairman or vice-chairman is in attendance.

d.       Council resolutions and recommendations will be passed by a majority vote of the attending members, and in the event of a tie, the chair of the meeting will have a casting vote.

e.       Resolutions and recommendations of the Council will be recorded in minutes of meetings to be signed by the chair of the meeting and attending members.

The Council Rapporteur

Article (6)

The chairman of the Council will appoint a rapporteur, who will convene the Council meetings, record the minutes of its sessions, follow up the implementation of its resolutions and recommendations, and perform any other duties assigned to him by the chairman of the Council.

Terms of Reference of the Council

Article (7)

The Council will set its terms of reference setting the procedure for convening meetings and members’ deliberations, and determining their duties and functions.

The Executive Body of the Council

Article (8)

a.       The Council will have an executive body comprised of a number of specialised employees.

b.       The duties and functions of the executive body of the Council will be determined by virtue of a regulation to be issued by the Council for this purpose.

c.       The rights and obligations of the employees of the Council and the procedures of their appointment will be determined by virtue of a resolution issued by the Council.

Cooperation with the Council

Article (9)

All Government entities in the Emirate will extend full cooperation, offer every kind of support to the Council, and provide the Council with such documents, data, information, statistics, and studies as it may request and as are considered necessary for performing its duties under this Decree.

Financial Resources of the Council

Article (10)

The financial resources of the Council will consist of:

1.    funds allocated to the Council by the Authority;

2.    revenues generated by the Council through performing its duties as set out in this Decree;

3.    grants, gifts, and donations approved by the Council; and

4.    any other resources approved by the Council.

Publication and Commencement

Article (11)

This Decree will be published in the Official Gazette and will come into force on the day on which it is published.
