Executive Council Resolution No. (14) of 2012

Forming the

Supreme Maritime Affairs Committee in the Emirate of Dubai[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,

After perusal of:

Federal Law No. (19) of 1993 Determining the Maritime Zones of the United Arab Emirates;

Federal Law by Decree No. (1) of 2001 Concerning Guarding the Land and Sea Borders of the United Arab Emirates;

The Dubai Police Law of 1966;

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Law No. (17) of 2005 Establishing the Roads and Transport Authority;

Law No. (11) of 2007 Establishing the Dubai Maritime City;

Law No. (11) of 2010 Concerning the Licensing of Vessels in the Emirate of Dubai; and

The Order of 1961 Establishing the Dubai Municipality, and

With a view to coordinating the efforts of the Government entities supervising maritime activities and ensuring contribution of the maritime sector in achieving sustainable development in the Emirate of Dubai,

Do hereby issue this Resolution.

Article (1)

Pursuant to this Resolution, a committee named the “Supreme Maritime Affairs Committee in the Emirate of Dubai” (the “Committee”) is formed within the Executive Council under the chairmanship of Lieutenant General Dhahi Khalfan Tamim, Commander-in-Chief of the Dubai Police and with the membership of:

1.    the Chairman of the Board of Directors and Executive Director of the Roads and Transport Authority, as member; 

2.    the Director General of the Dubai Municipality, as member;

3.    the Director General of the Customs Department, as member;

4.    the Director General of the Government of Dubai Legal Affairs Department, as member;

5.    the Chief Executive Officer of the Dubai Maritime City Authority, as member; and     

6.    a representative from the Dubai Police, as member.

Article (2)

Without prejudice to the functions of the Government entities in charge of supervising maritime activities in the Emirate of Dubai, the Committee will be in charge of following up and coordinating the efforts of the entities responsible for supervising maritime activities, and for considering any maritime-related matters in the Emirate of Dubai. In particular, the Committee will:

1.    review the strategic policy for maritime navigation in the Emirate of Dubai and submit the same to the Executive Council for approval;

2.    review the plans and programmes required for the implementation of the general maritime policy and achievement of the strategic maritime objectives adopted in the Emirate of Dubai;

3.    approve the studies submitted to it in respect of all matters related to maritime navigation safety and security, including Vessel routes within the Territorial Waters of the Emirate of Dubai, the speed limits on these routes, the zones designated for conducting maritime activities, maritime safety standards and requirements, and maritime accident investigation criteria;

4.    review the procedures required to coordinate the work of the Government entities supervising various activities within the Territorial Waters of the Emirate of Dubai;

5.    approve an emergency plan to deal with maritime accidents that may affect the marine environment and determine the role of concerned entities in implementing this plan; and

6.    review, and propose the necessary updates of, the legislation regulating maritime activities.

Article (3)

For the purpose of performing the duties assigned to it pursuant to this Resolution, the Committee will have the authority to:

1.    form the required executive committees and work teams and determine their duties and functions;

2.    seek, as it deems appropriate, assistance from experts and specialists to provide it with opinion and advice; and

3.    refer the decisions and recommendations it issues to the concerned entities to take the necessary action in respect thereof.

Article (4)

The Committee will convene at least once every three (3) months or where necessary. The Committee meetings will be valid if attended by the majority of its members, provided that the chairman of the Committee is in attendance. The Committee will issue its resolutions by majority vote of the attending members; and in the event of a tie, the chairman of the Committee will have a casting vote. Resolutions of the Committee will be recorded in minutes signed by its chairman and the attending members.

Article (5)

The chairman of the Committee will appoint a rapporteur, who will send invitations to attend the meetings of the Committee, record its minutes of meetings, follow up the implementation of its resolutions and recommendations, and perform any other duties assigned to him by the chairman of the Committee.

Article (6)

All Government entities must fully cooperate with the Committee and provide it with all the required data and information.

Article (7)

The chairman of the Committee will submit periodic reports to the Executive Council on the outcomes of the Committee’s work and its recommendations. The General Secretariat of the Executive Council and the concerned Sectoral Committees will consider these reports then present them to the Executive Council for approval.

Article (8)

This Resolution comes into force on the day on which it is issued, and will be published in the Official Gazette.
