Administrative Resolution No. (201) of 2012

Concerning the Standards and Requirements for

Transporting Passengers by Buses in the Emirate of Dubai[1]

The Chairman of the Board of Directors and Executive Director of the Roads and Transport Authority,

After perusal of:

Law No. (17) of 2005 Establishing the Roads and Transport Authority; and

Executive Council Resolution No. (33) of 2011 Regulating the Transport of Passengers by Buses in the Emirate of Dubai,

Does hereby issue this Resolution.

Definitions

Article (1)

The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise:

Emirate:

The Emirate of Dubai.

RTA:

The Roads and Transport Authority.

PTA:

The Public Transport Agency of the RTA.

Establishment:

A company or corporation registered in the Emirate to conduct the activity of transporting Passengers by Buses.

Bus:

A vehicle designated for transporting more than fourteen (14) Passengers, including the Driver.

Driver:

The driver of a Bus.

Obligations of Establishments

Article (2)

An Establishment wishing to operate Buses on fixed routes and at scheduled timings within and outside of the Emirate must:

1.    conduct a feasibility study, propose the fares for the services it provides, and submit the same to the RTA for approval;

2.    obtain approval from the RTA and the Dubai Department of Economic Development to conduct its activity;

3.    meet the safety and security requirements adopted by the RTA in respect of the Establishment and its Buses;

4.    register its Buses as per the procedures adopted by the RTA;

5.    provide the documents and information proving its capability to conduct its activity;

6.    obtain a no-objection certificate from the PTA for conducting its activity;

7.    use the routes, lanes, stations, and stops designated by the PTA for the Public Transport;

8.    conduct periodic maintenance for Buses;

9.    display the Bus timetables within the stops and stations designated for embarkation and disembarkation of Passengers, and provide information on the routes and network of its Buses;

10.  subject to the approval of the PTA, notify the public using brochures and other printed materials of any changes to the Bus timetables at least fourteen (14) days prior to the change effective date;

11.  raise Passengers' awareness of the way of using Buses, the rules that must be followed to maintain general safety thereon, and the acts that are prohibited on the Buses;

12.  state the method of payment of the prescribed fare, whether using smart electronic cards or cash, or by producing season tickets; and

13.  designate places for selling tickets, explain the different types of these tickets, and supply the same based on the type of the offered service.

Bus Specifications

Article (3)

In addition to the specifications and fittings that the PTA deems necessary to be available in a Bus, the following specifications and requirements must be met by the Bus:

a.    Exterior Specifications:

1.    The Public Transport logo approved by the RTA must be affixed to both sides of the Bus.

2.    The Bus number must be written on the uppermost right front end and left rear end of the Bus.

3.    The Bus must be equipped with mirrors that reflect the surroundings of the Bus from all directions.

4.    The sign “Give Way” must be affixed to the uppermost left rear end of the Bus.

5.    An electronic information sign must be installed in the Bus to display the route and destination of the Bus.

6.    No writings and advertisements may be displayed on the exterior of the Bus without the approval of the PTA.

b.    Interior Specifications:

1.    The number of seats determined by the manufacturer must be maintained, and no additional folding seats may be used.

2.    The seats of the Bus must be comfortable.

3.    The Bus must minimally be a fourteen-seater.

4.    The front seats must be allocated for persons with disabilities, women, and the elderly.

5.    Luggage racks must be fitted within the twenty-five seater Bus.

6.    The instructions prescribed by the RTA in respect of emergency procedures must be displayed in a prominent place in both Arabic and English languages.

7.    A dustbin must be placed on board the Bus.

8.    The Bus must be equipped with an air conditioning system which maintains the temperature within the Bus three degrees lower or higher than twenty-four degrees Celsius (24).

c.     Security and Safety Requirements:

1.    The Bus must be designed by the manufacturer for transporting Passengers and compatible with the type of the service provided (intracity or intercity transport).

2.    The Bus must be equipped with a first-aid kit; a six (6) kilogram fire extinguisher located near the driver’s seat and designed to extinguish all types of fire; and a sign indicating the place of the fire extinguisher.

3.    The Bus must be equipped with emergency window breakers.

4.    The Bus must have clearly marked emergency exists that are commensurate with the number of its seats.

5.    All Passenger seats, on Buses used for intracity Passenger transport, must be fitted with two-point seat belts. Passenger seats with no seats in front of them, such as front seats, the middle seat of the last row, and the driver’s seat, must be fitted with three-point seat belts.

6.    Neither the interior nor the exterior of the Bus may feature any sharp edges.

Bus Driver's Permit

Article (4)

a.    No person may drive a Bus unless he has obtained the relevant permit from the PTA. He will be issued with such a permit subject to the following requirements:

1.    he must be holding a driving licence for the specific type of Bus he drives;

2.    he must successfully complete the Driver training courses;

3.    he must be at least twenty five (25) years of age;

4.    he must be of good character and repute;

5.    he must submit a black-points report issued by the competent entities;

6.    he must submit a disease-free certificate, and proof of being drug-free and alcohol-free, issued by the competent entities in the Emirate;

7.    he must carry the permit with him while driving the Bus.

8.    he must be literate in both Arabic and English.

9.    he must pass the theoretical test prepared by the PTA.

b.    The permit referred to in paragraph (a) of this Article will be valid for a period of one (1) year, renewable for the same period.

c.     An Establishment may request the PTA to cancel the permit of the Driver referred to in this Article upon the end of his service with it.

Commencement and Publication

Article (5)

This Resolution comes into force on the day on which it is issued, and will be published in the Official Gazette.
