Executive Council Resolution No. (40) of 2011

Concerning

Payment by Instalments of Traffic Fines in the Emirate of Dubai[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,

After perusal of:

Federal Law No. (3) of 1987 Issuing the Penal Code and its amendments;

Federal Law No. (35) of 1992 Issuing the Criminal Procedures Law and its amendments;

Federal Law No. (21) of 1995 Concerning Road Traffic and its Implementing Bylaw and their amendments;

The Dubai Police Law of 1966;

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai; and

Law No. (35) of 2009 Concerning Management of the Public Funds of the Government of Dubai,

Do hereby issue this Resolution.

Article (1)

Fines for traffic violations committed in the Emirate of Dubai may be paid by instalments in accordance with the conditions and the periods stipulated in this Resolution.

Article (2)

a.       To be eligible to pay fines for traffic violations committed in the Emirate of Dubai by instalments, the following conditions must be met:

1.       the amount of fines claimed must not be less than three thousand Dirhams (AED 3000) for individuals, and twenty thousand Dirhams (AED 20,000) for corporations and companies;

2.       an applicant for payment by instalments must make an initial payment of thirty percent (30%) of the total amount of fines claimed from individuals, and fifty percent (50%) of the total amount of fines claimed from companies and corporations;

3.       the instalment period may not exceed one (1) year;

4.       instalments must be paid by bank cheques; and

5.       the fines required to be paid by instalments must not have already been reduced pursuant to the regulations concerning reduction of traffic fines applicable in the Emirate of Dubai.

b.       In addition to the requirements stipulated in paragraph (a) of this Article, Dubai Police General Headquarters may set any other requirements for the payment by instalments of traffic fines.

Article (3)

A fee of fifty Dirhams (AED 50) for each cheque issued to Dubai Police General Headquarters will be collected from an applicant for payment by instalments of traffic fines.

Article (4)

The fees collected pursuant to this Resolution will be paid to the Public Treasury of the Government of Dubai.

Article (5)

Nothing in this Resolution will prejudice the right to take legal and judicial action where a cheque issued for payment by installments of traffic fines is returned unpaid by the drawee bank.

Article (6)

The General Commander of Dubai Police will issue the bylaws and instructions required for the implementation of the provisions of this Resolution.

Article (7)

This Resolution comes into force on the day on which it is issued, and will be published in the Official Gazette.
