Trade in Vehicle Number Plates in the Emirate of Dubai[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,

After perusal of:

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Law No. (17) of 2005 Establishing the Roads and Transport Authority;

Law No. (14) of 2009 Concerning the Pricing of Government Services in the Emirate of Dubai;

Law No. (35) of 2009 Concerning Management of the Public Funds of the Government of Dubai;

Executive Council Resolution No. (8) of 2008 Establishing the Licensing Agency of the Roads and Transport Authority; and

Executive Council Resolution No. (13) of 2010 Approving the Organisational Structure of the Roads and Transport Authority,

Do hereby issue this Resolution.

Definitions

 Article (1)

The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise:

Emirate:

The Emirate of Dubai.

RTA:

The Roads and Transport Authority.

Chairman of the Board of Directors:

The Chairman of the Board of Directors and Executive Director of the RTA.

Agency:

The Licensing Agency of the RTA.            

Person:

A natural or legal person.

Vehicle:  

A motorised machine, motorcycle, carriage or any other machine adapted to run on roads whether mechanically propelled or otherwise.

Business:

Trading in Vehicle number plates.  

Permit:

Official document issued by the Agency which authorises a Person to conduct the Business.

Permit Holder:

A Person who conducts the Business.

Conducting the Business

Article (2)

a.       No Person may conduct the Business in the Emirate unless that Person obtains a Permit from the Agency and a license from the Department of Economic Development.

b.       A Permit will be valid for a period of one (1) year renewable for the same period. The conditions and requirements for obtaining the Permit  and documents required to issue it will be determined by a resolution issued by the Chairman of the Board of Directors.

c.       Pursuant to this Resolution, a register of Vehicle number plates (the “Register”) will be maintained by the Agency. The Chairman of the Board of Directors will determine the form of the Register and the data to be entered in it, including the names of Persons authorised to conduct the Business in the Emirate.

Obligation of the Agency Staff

    Article (3)

Subject to disciplinary action, employees of the Agency may not conduct the Business, whether in person, through third parties, or otherwise.

Permit Fees

Article (4)

The RTA will charge the fees specified in the attached Schedule (1) in return for the Permits and services it provides pursuant to this Resolution.

Security Deposit

Article (5)

a.       RTA will collect from the Permit Holder a cash security deposit of twenty five thousand Dirhams (AED 25,000) for participating in any Vehicle number plate auction organised by the Agency.

b.       The security deposit referred to in paragraph (a) of this Article will be refunded to a Permit Holder whose bid has not been successful and to a Permit Holder who paid the price of number plates awarded to him at the auction.

c.       The security deposit referred to in paragraph (a) of this Article will be forfeited where a Permit Holder whose bid has been successful fails to pay the price of the Vehicle number plates awarded to him within ten (10) days from the date of winning the auction.

Obligations of the Permit Holder

Article (6)

A Permit Holder must abide by the conditions and requirements adopted by the Agency when conducting the Business, and may not perform any of the following acts:

1.       conducting any business other than the Business authorised within the service centres of the Agency;

2.       discontinuing or ceasing to conduct the Business for a period exceeding six (6) months without notifying the Agency;

3.       organising Vehicle number plate auctions without obtaining the prior approval of the Agency;

4.       allowing others to use the Permit without obtaining the prior approval of the Agency;

5.       selling the same Vehicle number plate to more than one (1) Person;

6.       advertising the Business in the service centres of the Agency without obtaining prior approval of the Agency; or

7.       delaying or obstructing the work of the RTA employees.

Penalties

Article (7)

Without prejudice to any stricter penalty stipulated in any other legislation, a Person who commits any of the violations stipulated in Schedule (2) attached to this Resolution will be punished by the fine indicated opposite that violation. Upon repetition of the same violation within one (1) year from the date of the previous violation, the value of the fine will be doubled, provided that the fine will not exceed thirty thousand Dirhams (AED 30,000).

Punitive Measures

Article (8)

In addition to the penalty of a fine prescribed pursuant to Article (7) of this Resolution, the Agency may take one or more of the following measures against a Permit Holder:

1.       suspending the Permit for a period not exceeding two (2) months;

2.       suspending the procedures of disposing of the Vehicle number plate listed in the traffic file of the Permit Holder for a period to be specified by the Agency;

3.       excluding the Permit Holder from participating in the Vehicle number plate auctions held by the Agency for a period to be specified by the Agency; and/or

4.       revoking the Permit.

Grievance

Article (9)

A Permit Holder may submit a written grievance against any decisions or measures taken against him by the Agency under this Resolution within a period not exceeding thirty (30) days from being notified thereof. Such grievances will be considered by a committee formed by the Chairman of the Board of Directors. A grievance must be determined by the committee within a period not exceeding fifteen (15) days from the date on which it is filed. The decision of the committee in respect of the grievance will be final.

Law Enforcement Officers

Article (10)

Officers and inspectors of the RTA nominated by a resolution issued by the Chairman of the Board of Directors will have the capacity of law enforcement officers to record the acts committed in breach of the provisions of this Resolution and the resolutions issued in pursuance hereof.  For this purpose, they may issue the necessary violation reports.

Payment of Fees

Article (11)

The fees and fines collected pursuant to this Resolution will be paid to the Public Treasury of the Government of Dubai.

Compliance

Article (12)

All Persons conducting the Business in the Emirate by the effective date of this Resolution must comply with the provisions of this Resolution within six (6) months from the date on which it comes into force.

Implementing Resolutions

Article (13)

The Chairman of the Board of Directors will issue the resolutions and instructions required for the implementation of the provisions of this Resolution.

Publication and Commencement

Article (14)

This Resolution will be published in the Official Gazette and will come into force on the date on which it is published.
