Executive Council Resolution No. (16) of 2011

Approving the

Electricity and Water Tariff in the Emirate of Dubai[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,

After perusal of:

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Law No. (14) of 2009 Concerning the Pricing of Government Services in the Emirate of Dubai;

Law No. (19) of 2009 Establishing the Supreme Council of Energy;

Law No. (35) of 2009 Concerning Management of the Public Funds of the Government of Dubai; and

Decree No. (1) of 1992 Establishing the Dubai Electricity and Water Authority (“DEWA”) and its amendments,

Do hereby issue this Resolution.  

Article (1)

Pursuant to this Resolution, the electricity and water consumption tariff in the Emirate of Dubai, as prescribed for the categories and slabs indicated in Schedules (1) and (2) attached hereto, is approved.

Article (2)

a.    In addition to the electricity and water consumption tariff stipulated in Article (1) of this Resolution, DEWA may add a fuel surcharge to consumers' monthly bills.

b.    The average fuel prices in 2010 will be adopted as the basis for calculating fuel surcharge.

c.     The fuel surcharge referred to in paragraph (a) of this Article will be subject to increase or decrease based on periodic reviews by DEWA.

d.    The fuel surcharge will be determined and charged to each consumer category on a monthly basis by a resolution of the Chief Executive Officer of DEWA.

e.    The estimated fuel surcharge will be announced on DEWA website and through various media at the beginning of the month in which it will be charged.

f.      The monthly bills of UAE nationals' private residences and farms will not be subject to the fuel surcharge.

Article (3)

This Resolution comes into force on 1 January 2011, and will be published in the Official Gazette.
