Approving Fees
and Fines of the
Department
of Economic Development[1]

We, Hamdan
bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the
Executive Council,
After perusal of:
Law No. (7) of 1995 Concerning the
Financial Regulations of Government Departments in the Emirate of Dubai and its
Implementing Bylaw;
Law No. (3) of 2003 Establishing
the Executive Council of the Emirate of Dubai;
Law No. (4) of 2005 Imposing the
Knowledge Dirham Fee and its amendments;
Law No. (25) of 2008 Concerning
the Department of Economic Development;
Law No. (14) of 2009 Concerning
the Pricing of Government Services in the Emirate of Dubai;
Law No. (35) of 2009 Concerning
Management of the Public Funds of the Government of Dubai; and
Local Order No. (114) of 1997 Regulating
the Sale at Reduced Prices in the Emirate of Dubai,
Do hereby
issue this Resolution.
The
following words and expressions, wherever mentioned in this Resolution, will
have the meaning indicated opposite each of them unless the context implies
otherwise.

Establishment: |
A company or sole proprietorship licensed to conduct an Economic Activity
in the Emirate |
The fees for services rendered by the DED which are listed in
Schedule (1) attached hereto are hereby approved.
a. Without prejudice
to any stricter penalty stipulated in any other legislation, the fines for
violations stipulated in Schedule (2) attached hereto are hereby approved.
b.
Upon
repetition of the same violation within (1) year from the date of the previous
violation, the amount of the fine prescribed in paragraph (a) of this Article
will be doubled. A fine must not exceed one hundred thousand Dirhams (AED 100,000.00).
c.
In addition
to the penalty of a fine prescribed under this Article, the DED may take one or
more of the following measures against a violating Establishment:
1.
closing the
Establishment for no more than six (6) months;
2.
confiscating
the seized goods; and/ or
3.
revoking
the commercial or professional licence.
Employees of the DED nominated by a
resolution of the Director General will have the capacity of law enforcement officers
to record the violations set out in Schedule (2) attached hereto. In this
capacity, they may issue the necessary violation reports.
An Establishment licensed by the DED will not
be subject to the fees prescribed in Schedule (1) attached hereto for
conducting its activity where it is proven that this Establishment ceased to
conduct its activity during the period for which these fees are chargeable.
The Director General will issue the bylaws required
for the implementation of the provisions of this Resolution.
Any provision in any other legislation will
be repealed to the extent that it contradicts the provisions of this
Resolution.
This Resolution will be published in the Official Gazette and will come into force
on the day on which it is published.
