Law No. (8) of 2009

Concerning 

Liability of Heads and Directors of Government of Dubai Entities[1]

We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

Do hereby issue this Law.

Article (1)

Neither the heads of government entities affiliated to the Government of Dubai; nor the chairmen or members of their boards of directors, office management, or boards of trustees; nor their directors general or executive directors/chief executive officers will incur liability towards third parties for any act or omission in respect of the exercise of their functions in the course of performing their job duties. Without prejudice to the Government’s right to have recourse against the person responsible for an act or omission that is committed wilfully or as a result of gross fault, the Government will be solely liable for such an act or omission.

For the purposes of this Article, government entities mean departments, authorities, and public corporations, including free zone authorities and government councils affiliated to the Emirate of Dubai.

 

Article (2)

 

This Law comes into force on the day on which it is issued, and will be published in the Official Gazette.
