Law No. (34) of 2009

Concerning the

Dubai Export Development Corporation[1]

We, Mohammad bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Law No. (10) of 2006 Establishing the Dubai Export Development Corporation;

Law No. (27) of 2006 Concerning Management of the Government of Dubai Human Resources; and

Law No. (25) of 2008 Concerning the Department of Economic Development,

Do hereby issue this Law.

Article (1)

This Law will be cited as "Law No. (34) of 2009 Concerning the Dubai Export Development Corporation".

Article (2)

The following words and expressions, wherever mentioned in this Law, will have the meaning indicated opposite each of them unless the context implies otherwise:

Emirate:

The Emirate of Dubai.

Executive Council:

The Executive Council of the Emirate of Dubai.

DED:

The Department of Economic Development.

Director General:

The director general of the DED.

DEDC:

The Dubai Export Development Corporation.

CEO:

The chief executive officer of the DEDC.

Programme:

The Export Promotion Programme.

Establishment:

Small and medium-sized companies and corporations licensed to operate in the Emirate.

 

Article (3)

This Law will apply to the DEDC established pursuant to Law No. (10) of 2006. The DEDC will maintain its own legal personality and exercise the duties and powers assigned to it in accordance with this Law. The DEDC will be affiliated to the DED.

Article (4)

The head office of the DEDC will be located in Dubai. The DEDC may establish other branches and offices within or outside of the Emirate.

Article (5)

The DEDC aims to:

1.       promote the Emirate as a global export and re-export hub;

2.       contribute to building and improving local export capabilities;

3.       develop programmes and initiatives intended to increase the volume of local exports, and develop and analyse key performance indicators to measure the effectiveness of such programmes and initiatives; and

4.       contribute to creating opportunities in international markets with a view to facilitating the export of products and services of the Emirate to such markets, and promoting these products and services.

Article (6)

The DEDC will have the functions and duties to:

1.       develop the policies and strategic plans that enhance implementation of export development and promotion programmes and initiatives;

2.       determine the standards that must be met by Establishments and their products to be registered with the Programme;

3.       review and analyse the current trend of exports in the Emirate, identify and overcome obstacles to the development of exports, and explore potential opportunities;

4.       propose legislation that contributes to the development of the export sector, including the internal regulations of the Programme;

5.       provide business information and technical advice to the export sector;

6.       identify targeted export markets and determine the products and services that can be exported to these markets;

7.       propose, in coordination with the concerned Government entities, export development-related trade agreements with other countries and international organisations;

8.       plan and implement initiatives that aim to raise awareness about the export sector and the latest developments related to international trade issues;

9.       assist other corporations and companies in developing their capabilities to market their products in international markets;

10.   consolidate relations between manufacturers and service providers in the Emirate and importers;

11.   coordinate with federal and local public and private entities to enhance the competitiveness of the exports of the Emirate;

12.   consider complaints of exporters and settle them in coordination with the relevant local, federal, and international authorities; and

13.   support and diversify local export products, in accordance with the international standards, and promote high value-added industries.

Article (7)

The DEDC will develop a Programme known as the "Export Promotion Programme" that aims to increase the exports of the Emirate, to promote the products and services of Establishments that have potential in international markets, and to provide financial support to the promotion of such products and services.

Article (8)

In accordance with the Programme operational plan approved by the Director General, the DEDC will promote exports through the following:

1.       participating in international trade exhibitions and events and international tenders, and organising marketing visits;

2.       conducting studies and providing information on export markets to help develop products and guide the activities of Establishments;

3.       developing trademarks of exports in coordination with Establishments; and

4.       organising training workshops on exports.

Article (9)

All local public and private entities must, when requested, provide the DEDC with all data and statistics related to foreign trade.

Article (10)

A CEO will be appointed to the DEDC pursuant to a resolution of the Chairman of the Executive Council. The CEO will have the powers and duties to:

1.       propose legislation related to the work of the DEDC;

2.       propose policies and strategic plans related to the work of the DEDC and the Programme, and submit these to the Director General for approval;

3.       prepare the action plan, draft annual budget, and final accounts of the DEDC, and submit these to the Director General for approval;

4.       supervise the day-to-day work of the DEDC;

5.       achieve the required performance outcomes, and submit performance reports to the Director General;

6.       represent the DEDC before third parties and enter into contracts and agreements as required to achieve the objectives of the DEDC; and

7.       perform any other duties assigned to him by the Director General.

Article (11)

The financial resources of the DEDC will consist of:

1.       support allocated to the DEDC in the budget of the DED;

2.       revenues generated by the DEDC through conducting its activities and providing its services; and

3.       any other resources approved by the Executive Council.

Article (12)

In regulating its accounts and records, the DEDC will apply the accounting rules and standards approved by the Government of Dubai. The financial year of the DEDC will commence on 1 January and will end on 31 December of each year.

Article (13)

Law No. (27) of 2006 Concerning Management of the Government of Dubai Human Resources will apply to the Employees of the DEDC.

Article (14)

The Chairman of the Executive Council will issue the regulations and resolutions required for the implementation of the provisions of this Law.

Article (15)

Law No. (10) of 2006 Establishing the Dubai Export Development Corporation is hereby repealed. Any provision in any other legislation will also be repealed to the extent that it contradicts the provisions of this Law.

Article (16)

This Law comes into force on the day on which it is issued, and will be published in the Official Gazette.
