Amending

Law No. (8) of 1992 Concerning the Public Prosecution[1]

We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Law No. (8) of 1992 Concerning the Public Prosecution and its amendments,

Do hereby issue this Law.

Article (1)

Article (10) of the above-mentioned Law No. (8) of 1992 is hereby superseded by the following:

Article (10)

a.     Appointment to the Public Prosecution will start with the grade of an assistant prosecutor.

b.    To be appointed to the Public Prosecution, a candidate must:

1.     be a Muslim, of full legal capacity, not have been convicted of any felony or misdemeanour affecting honour or trustworthiness, and be of good conduct and repute;

2.      be a UAE-national, but where necessary, a citizen of another Arab country may be appointed;

3.     hold a Bachelor’s degree in Islamic Sharia or Law from an accredited university or institute;

4.     have practised a judicial or legal profession at or before a court of justice, held a position at the Public Prosecution, taught Islamic Sharia or Law at an accredited university or higher institute, or practised the legal profession for at least the period indicated opposite each post in the Public Prosecution that is required for promotion to the higher grade or for appointment, as follows:

-          three (3) years at the grade of senior chief prosecutor to be promoted to the grade of advocate general;

-          three (3) years at the grade of chief prosecutor to be promoted to the grade of senior chief prosecutor;

-          three (3) years at the grade of senior prosecutor to be promoted to the grade of assistant chief prosecutor;

-          three (3) years at the grade of prosecutor to be promoted to senior prosecutor; and

-          two (2) years at the grade of assistant prosecutor to be promoted to the grade of prosecutor.

c.     Any person may, by a resolution of the Ruler, be exempt from the relevant minimum period requirement set out in Paragraph (b-4) of this Article.

Article (2)

This Law comes into force on the day on which it is issued, and will be published in the Official Gazette.
