Amending Administrative Resolution No. (311) of 2007

Issuing the Implementing Bylaw of the

Law Concerning the Traffic Toll in the Emirate of Dubai (Salik)[1]

The Chairman of the Board of Directors and Executive Director of the Roads and Transport Authority,

After perusal of:

The powers vested in him pursuant to Law No. (17) of 2005 Establishing the Roads and Transport Authority in Dubai;

Law No. (22) of 2006 Concerning the Traffic Toll in the Emirate of Dubai;

Executive Council Resolution No. (17) of 2006 Adopting the Fees and Fines Related to the Law Concerning Traffic Toll in the Emirate of Dubai;

Administrative Resolution No. (311) of 2007 Issuing the Implementing Bylaw of Law No. (22) of 2006 Concerning Traffic Toll in the Emirate of Dubai; and

The presentations of the Chief Executive Officer of the Traffic and Roads Agency, the Director of the Legal Affairs Directorate and the Director of the Development and Corporate Performance Directorate, and

In accordance with work requirements,

Does hereby issue this Resolution.

Article (1)

Articles (10), (13), (14), (15) and (16) of the above-mentioned Administrative Resolution No. (311) of 2007 are hereby superseded by the following:

Article (10)

A User or Commercial User must:

1.    maintain sufficient credit balance in his account to cover the Traffic Toll fees;

2.    use the Salik Tag when passing through Traffic Toll Gates or using roads controlled by any other toll systems to be adopted by the RTA;

3.    ensure that the Salik Tag is properly installed by affixing it in the place specified in the Instructions Manual to ensure that correct data of the Salik Tag is read by the toll device;

4.    regularly update his account information and data;

5.    apply for cancellation of the Salik Tag where the vehicle is written off or its ownership is transferred to a third party;

6.    pay all the fees and fines payable in respect of the Vehicle up to the date of cancellation of the Salik Tag; and

7.    pay for any damage or loss resulting from misuse of the Salik Tag, including loss thereof.

Article (13)

A Vehicle which passes through a Toll Gate without being registered in the Salik System will be granted a grace period of ten (10) working days from the date of this violation to subscribe to the Salik System. Compliance with this requirement during the grace period will result in cancellation of the fine and deduction of the toll amount from the balance available in the relevant Salik account.

Article (14)

A subscriber to the Salik System who passes through a Toll Gate without having sufficient credit balance in his Salik account will be granted a grace period of five (5) working days following the date of this violation to credit his account. Compliance with this requirement during the grace period will result in cancellation of the fine and deduction of the toll amount from the balance available in the account.

Article (15)

Irrespective of the number of repetitions of a violation on a single day, the daily fine for each violating vehicle will be as follows:

1.    Passing through a Traffic Toll Gate without Subscription to the Salik System

·         one hundred Dirhams (AED 100.00) for the first day;

·         two hundred Dirhams (AED 200.00) for the second day; and

·         four hundred Dirhams (AED 400.00) for the third or subsequent days.

2.    Passing through a Traffic Toll Gate without Having Sufficient Balance in the Account

·         fifty Dirhams (AED 50.00) per day.

Article (16)

A User or Commercial User on whom a fine is imposed may take the following actions:

1.    request the details of the violation within ninety (90) days from the date of violation; and

2.    submit a grievance to the concerned department specified by the Chief Executive Officer of the Traffic and Roads Agency of the RTA within thirty (30) days from the date of receiving the details of the violation. The Traffic and Roads Agency must cancel the fine after verifying the validity of grievance.

Article (2)

This Resolution comes into force on the day on which it is issued, and will be published in the Official Gazette.
