Issuing the Implementing Bylaw of
Regulation No. (1) of 2008 Concerning
Permits for Using Designated Car Parks in the
Emirate of Dubai[1]

perusal of:
The powers vested in him
pursuant to Law No. (17) of 2005 Establishing the Roads and Transport Authority
in Dubai;
Federal Law No. (21) of 1995
Concerning Road Traffic, its Implementing Bylaw, and their amendments;
Federal Law No. (29) of 2006
Concerning Rights of Persons with Special Needs;
Executive Council Resolution
No. (8) of 2008 Establishing the Licensing Agency of the Roads and Transports
Authority; and
Regulation No. (1) of 2008
Concerning Permits for Using Designated Car Parks in the Emirate of Dubai, and
In accordance with work requirements,
Does
hereby issue this Resolution.
The words and expressions set
out in this Resolution will have the meaning indicated in Article (1) of the
Regulation, and the following words and expressions will have the meaning
indicated opposite each of them unless the context implies otherwise:

Medical Report: |
A medical report
certified by a Concerned Entity using the form prescribed by the Competent
Department. |
Manual: |
The
infrastructure design manual of transportation facilities and systems. |
Permit: |
The official
document issued by the Competent Department which grants its holder, based on
the category of that holder, the rights, and enables him to use the services,
stated in the Regulation and the resolutions issued in implementation
thereof. |
Card: |
A personalised card
issued by the Ministry of Social Affairs to a Person with Special Needs. This
card is an official document indicating that its holder is a Person with
Special Needs and that he is entitled to the rights and services stated in
the Regulation and the resolutions issued in implementation thereof. |
Person: |
A natural person. |
Senior Citizen: |
A man who is over
sixty-five (65) years of age, or a woman who is over seventy (70) years of
age. |
Concerned Entity: |
The Dubai Health
Authority, the Ministry of Health or any of its affiliated hospitals and
health centres, or a centre for the care and rehabilitation of Persons with Special Needs recognised by the
Ministry of Social Affairs. |
An application for a Permit for
using Designated Car Parks will be submitted to the Competent Department on the
form prescribed by it for this purpose, accompanied by the documents required
for the
respective Permit type, in accordance with the requirements stipulated in this
Resolution. A Permit renewal application will be submitted in accordance with the same
procedures prescribed for its initial issuance.
A Permit for using Designated Car
Parks will be issued or renewed based on a Medical Report or on a Card issued by the
Ministry of Social Affairs, in accordance with the requirements stipulated in
the Schedule attached to this Bylaw.
Requirements for issuing
various types of Permits for using Designated Car Parks are as follows:
I. Permanent Permits
1.
A permanent Permit will be issued to a Person with
permanent disability who resides or works in the Emirate.
2.
This Permit will be valid for three (3) years.
II. Temporary Permits
1.
A temporary Permit will be issued to a Person with
temporary disability who resides or works in the Emirate.
2.
This Permit will be valid for a period of one (1) to
twelve (12) months and will be renewed based on a Medical Report.
3.
A new certified Medical Report which includes an update
on the health condition of the applicant is required for renewal of the Permit.
4.
The Competent Department reserves the right to determine whether to issue a permanent or a temporary Permit using the
form it prescribes in this respect.
III. Senior Citizen Permits
A Senior Citizen Permit will be
issued to a Senior Citizen who holds a Driver’s Licence issued in the Emirate
of Dubai or who has a Vehicle registered in the Emirate of Dubai based on a
certified Medical Report in the form prescribed by Competent Department.
IV. Permits for Vehicles of Centres for Rehabilitation of Persons with
Special Needs
1.
These Permits will be issued to non-profit
establishments or other entities specialised in the rehabilitation or transport
of Persons with Special Needs, provided that they have valid licences.
2.
These Permits will be valid throughout the period
of validity of Vehicle
licences.
3.
These Permits will be issued to the Vehicles
designed as per the specifications approved by the Concerned Entities for their
intended
purposes, and will
be renewed upon renewal of Vehicle licences.
V. Permits for Persons with Chronic Diseases
1.
These Permits will be issued to Persons who report
to hospitals on a regular basis and are used exclusively in hospital grounds.
2.
These Permits will be issued to Persons who reside
or work in the
Emirate, provided that they have vehicles registered in the Emirate.
3.
These Permits will be valid for the periods stated in the respective Medical
Reports.
VI. Permits for the Emirate's Tourists and Visitors with Special Needs
1.
These Permits will be issued to the Emirate’s tourists
and visitors with Special Needs subject to submission of Medical Reports.
2.
Tourists and visitors with Special Needs who have
valid equivalent permits issued in their home countries, and certified by the concerned entities
(embassies and diplomatic missions), will have their permits replaced without
submitting any Medical Reports.
3.
These Permits will be valid for three (3) months.
VII. Permits for Tourist Buses
1.
These Permits will be issued to establishments or
other entities specialised in tourist transport, provided that they have valid establishment
licences and valid tourist bus licences.
2.
These Permits will be used in the car park spaces designated for this
purpose in the Emirate,
where available, as
per the Schedule attached to this Bylaw.
3.
Each tourist bus registered in the name of an establishment
will be issued
with a Permit which
is renewable upon renewal of the bus licence.
4.
Visiting tourist buses that have valid equivalent
permits issued from their home countries will have their permits replaced. A Permit
will be valid for a maximum of one (1) month, or will expire at the end of the respective tourist visit.
A Designated Car Park will be
used for a limited period of four (4) hours, seven (7) days a week.
Where an application for a
Permit to use Designated Car Parks meets all the conditions and requirements
stipulated in the Regulation and this Resolution, the Permit will be issued and
will include the following details:

number of Permit;
·
passport-size photograph (depending on the type of
Permit);
·
name of Person with Special Needs, establishment,
or entity;
·
number of Vehicle (depending on the type of
Permit);
·
issue and expiry date of Permit;
·
type of Permit; and
·
any other details, as deemed necessary by the Competent Department.
Chief executive
officers/executive directors, department directors, managers, inspectors of the
Agency, and Traffic and Roads Agency controllers are hereby granted the
capacity of law enforcement officers to record the acts committed in breach of
the provisions of the Regulation and this Resolution, and to issue the
necessary violation reports in this respect.
The Agency will, in
coordination with any other entities, specify
the requirements and standards for providing Designated Car Parks in accordance
with the guidebook prepared for this purpose.
This Resolution comes into
force on the day on which it is issued, and will be published in the Official
Gazette.
