Concerning the

 Procedures and Requirements for Exempting Vehicle

Categories from Payment of the Traffic Toll (Salik)[1]

The Chairman of the Board of Directors and Executive Director of the Roads and Transport Authority,

After perusal of:

Federal Law No. (21) of 1995 Concerning Road Traffic and its Implementing Bylaw;

The powers vested in him pursuant to Law No. (17) of 2005 Establishing the Roads and Transport Authority;

Law No. (22) of 2006 Concerning the Traffic Toll in the Emirate of Dubai;

Executive Council Resolution No. (17) of 2006 Adopting the Fees and Fines Related to the Law Concerning the Traffic Toll in the Emirate of Dubai;

Administrative Resolution No. (311) of 2007 Issuing the Implementing Bylaw of Law No. (22) of 2006 Concerning the Traffic Toll in the Emirate of Dubai; and

In accordance with work requirements,

Does hereby issue this Resolution.

Article (1)

The following Vehicle categories are hereby exempted from payment of the Traffic Toll (Salik):

a.    public transport buses;

b.    Vehicles of the Armed Forces, the Police, and the Civil Defence;

c.     Vehicles of persons with special needs; and

d.    Vehicles of charitable and humanitarian foundations.

Article (2)

The procedures and requirements for exempting Vehicle categories from payment of the traffic toll (Salik) are as follows:

a.    A formal exemption application will be submitted to the Traffic and Roads Agency by an entity that meets the exemption eligibility requirements.

b.    The prescribed application form will be completed; and all the information and documents stipulated in Salik Application Form will be provided, including copies of the registration cards of the Vehicles to be exempted and any documents supporting eligibility for the exemption.

c.     The beneficiary of exemption will undertake to use the exempted Vehicles only for their intended purposes and subject to the prescribed conditions; and will be fully responsible for reporting any disposition of, or variation to, the Vehicle and for surrendering the relevant card to the RTA in case the Vehicle is disposed of or becomes a write-off.

d.    The beneficiary of exemption will assign an entity or department as contact point for purposes of the applications for exemption of each of the below-mentioned categories.

Article (3)

Exemption eligibility requirements, eligible categories, and types of Vehicles exempted from payment of the Traffic Toll (Salik) will be determined in accordance with the Schedule attached to this Resolution.

 

Article (4)

The procedures and requirements for exempting Vehicle categories from payment of the Traffic Toll (Salik) will be revised and updated every two (2) years, where required, in accordance with the instructions of the Chairman of the Board of Directors and Executive Director.

Article (5)

This Resolution comes into force on the day on which it is issued.

a.    Public Transport Buses:

Local and Federal Government Entity Staff Buses

-          Number of staff of the entity must not be less than one hundred (100)

-          Exemption applies to heavy buses as per the Road Traffic Law [twenty-six (26) passengers and above]

-          Emirates Transport Corporation

-          Dubai Municipality

-          Any other government entity that subsequently meets the eligibility requirements

Student Buses

-          The Vehicle must be owned by, and registered in the name of, the beneficiary of exemption.

-          Government and private schools

-          Government and private institutes

-          Government and private universities

Notes:

-          The exempted bus must be owned by the beneficiary of exemption or hired by a government entity.

-          Exemption does not apply to labour transport buses.

 

b.    Armed Forces, Police, and Civil Defence Vehicles:

-          Exemption applies to the Vehicles owned by the entity and bearing its logo.

-          Exemption applies to Vehicles bearing the Ministry of Interior’s logo and number plates.

A maximum of five hundred (500) Vehicles

Federal State Security Authority Vehicles

All emirates

-          Exemption applies to Vehicles owned by the Federal State Security Authority and used for security purposes.

c.    Vehicles of Persons with Special Needs:

Exemption Eligibility Requirements

Vehicles of associations and centres for persons with special needs

-          Exemption applies only to buses owned by these associations or centres in accordance with the Law.

-          Exemption applies to Vehicles which are equipped for use by specific categories of persons with special needs, and which are owned by associations or centres providing services to these categories.

-          Exemption must be approved by the Ministry of Social Affairs upon their assessment of the applicant's case.

-          Relevant cards will be delivered by the Ministry of Social Affairs to exempted associations.

-          Number of exempted Vehicles must be determined based on the size and nature of activities of the applicant association.

Vehicles of individuals with special needs

-          Exemption must be approved by the Ministry of Social Affairs.

-          Exemption applies to Vehicles issued with car park permits for persons with permanent, rather than temporary, special needs.

-          Exemption applies only to one (1) Vehicle for person belonging to this category.

-          The Vehicle must be intended for use by the beneficiary of exemption, regardless of the owner or driver of the Vehicle

Applications filed by persons who do not fall under any of the above categories will be considered on a case-by-case basis upon receipt of the Ministry of Social Affairs recommendation on the application.

The procedures for exemption of this category from payment of the Traffic Toll (Salik) will be applied in coordination with the Ministry of Social Affairs.

 

d.    Vehicles of Charitable and Humanitarian Foundations:

Vehicles of charitable associations and foundations registered in accordance with the law*

-          Exemption applies only to all Vehicles owned by these associations and foundations.

-          Exemption must be approved by the Ministry of Social Affairs or by the Ministry of Labour, depending on the jurisdiction of each ministry.

* Exemption applies to associations that have been established pursuant to laws which expressly provide for their exemption from fees.
