Implementing Bylaw of Law No. (22) of 2006

Concerning Traffic Toll in the Emirate of Dubai[1]

The Chairman of the Board of Directors and Executive Director of the Roads and Transport Authority,

After perusal of:

The powers vested in him pursuant to Law No. (17) of 2005 Establishing the Roads and Transport Authority;

Law No. (22) of 2006 Concerning Traffic Toll in the Emirate of Dubai; and

Executive Council Resolution No. (17) of 2006 Concerning the Fees and Fines Related to the Law Concerning Traffic Toll in the Emirate of Dubai,

Does hereby issue this Resolution.

Article (1)

The words and expressions set out in this Bylaw will have the meaning indicated in Article (2) of the Law, and the following words will have the meaning indicated opposite each of them unless the context implies otherwise:

 

Salik System:

The Traffic Toll system.

Tag:

A Traffic Toll electronic card affixed to Vehicles.

User:

A Vehicle Owner.

Commercial User:

A legal or corporate person who owns ten (10) motor Vehicles or more.

Instructions Manual:

A manual which includes all information about the Salik System and the method of installation and use of the Salik System.

Master Account:

An electronic account provided to the User by the RTA, which includes the personal information of the User and information of Vehicles owned by him, and through which all financial transactions of the User are conducted. 

Sub-account:

An electronic account linked to the Master Account, which is provided to a Commercial User by the RTA and which the User may use to pay for any of his Vehicles depending on the activities of the Commercial User.

Internal Sales and Collection Centres:

Customer service centres affiliated to the RTA, including the Licensing Directorate.

External Sales and Collection Centres:

Customer service centres affiliated to external entities with which the RTA concludes agreements for sale and collection.

Article (2)

Motor Vehicles may not pass through Traffic Toll Gates without payment of the Traffic Toll fees through subscription to the Salik System.

Article (3)

To subscribe to the Salik System, an applicant must complete all the information required in the Salik application form available at Internal Sales and Collection Centres and External Sales and Collection Centres.

Article (4)

A User will be charged one hundred Dirhams (AED 100) as subscription and Tag fees, of which fifty Dirhams (AED 50) will be credited to the account of the subscriber.

Article (5)

A User may register an indefinite number of Vehicles in the Salik System. Such Vehicles will be registered under the User’s account, and each Vehicle will have a separate Tag that may not be used for other Vehicles.

Article (6)

The RTA will provide the User with electronic and manual methods of payment to recharge his account through External Sales and Collection Centres and Internal Sales and Collection Centres.

Article (7)

A Commercial User may request to open a Sub-account to register his Vehicles depending on the activities of the Commercial User. The RTA may, in respect of its transactions, refer to the Master Account.

Article (8)

The minimum amount to recharge a User’s account will be fifty Dirhams (AED 50) and payments will be made in multiples of this amount.

Article (9)

Any balance remaining in the User’s account will be forfeited if not used within three (3) years from the date of the last deduction from the account for passing through a Traffic Toll Gate.

Article (10)

A User must:

1.       maintain sufficient balance in his account to cover the Traffic Toll fees;

2.       use the Tag when passing through Traffic Toll Gates or any other systems to be adopted later by the RTA;

3.       ensure that the Tag is properly installed by affixing it in the place specified in the Instructions Manual to ensure that correct data of the Tag is read by the toll device;

4.       regularly update the information and data of his account;

5.       notify the RTA of any variation to the ownership of the Vehicle mentioned in the application for subscription to the Salik System, in order for the RTA to modify the User’s account accordingly. This notification will be either by:

·         applying to transfer the Tag in the event of sale of the Vehicle, and paying a transfer fee of fifty Dirhams (AED 50); or

·         applying to cancel the Tag in the event of damage to the Vehicle or transfer of its possession, and paying a cancellation fee of ten Dirhams (AED 10);

6.       pay all fees and fines imposed on the Vehicle up to the date of transfer or cancellation of the Tag; and

7.       pay the cost of all damage or losses resulting from any misuse of the Tag, including loss of the Tag.

Article (11)

Traffic Toll fees will be charged upon passing through Traffic Toll Gates at any time throughout the week, provided that such fees may not exceed twenty four Dirhams (AED 24) per day for each Vehicle. This cap will not apply to taxicabs.

Article (12)

The RTA will provide each User with a separate electronic account, and will provide the technical support required to manage such account.

Article (13)

A Vehicle which is not registered in the Salik System will be granted a grace period of two (2) working days following the date of violation to subscribe to the Salik System. Compliance with the required action during the grace period will result in cancellation of the fine and a deduction of the toll amount from the balance available in the account.

Article (14)

A subscriber to the Salik System who does not have a sufficient credit balance in his account will be granted a grace period of two (2) working days following the date of violation to recharge his account. Compliance with the required action during the grace period will result in cancellation of the fine and a deduction of the toll amount from the balance available in the account.

Article (15)

Irrespective of the number of repetitions of the violation on a single day, the daily fine on any Vehicle passing through Traffic Toll Gates without a Tag will be as follows:

·         one hundred Dirhams (AED 100) for the first day;

·         two hundred Dirhams  (AED 200) for the second day; and

·         four hundred Dirhams (AED 400) for the third or subsequent days.

Article (16)

A User on whom a fine is imposed may:

1.       request details of the violation within thirty (30) days from the date of violation, after payment of administrative fees of ten Dirhams (AED 10); and

2.       submit a grievance to the relevant directorate specified by the Chief Executive Officer of the Traffic and Roads Agency of the RTA within fifteen (15) days from the date of receiving the details of the violation, in which case the Agency must cancel the fine where the validity of grievance is verified.

Article (17)

The following Vehicles will be exempt from the Traffic Toll fees:

1.       Vehicles of societies and centres for people with special needs;

2.       Vehicles of the Awqaf and Minors Affairs Foundation in Dubai;

3.       Vehicles intended for use by persons with special needs; and

4.       buses used for transportation of staff and workers, in accordance with the requirements prescribed by the RTA.

Article (18)

This Resolution will be published in the Official Gazette and will come into force on 1 July 2007.
