Concerning
Calculation
and Collection of the Costs of Repair of
Roads
Affected by Accidents in the Emirate of Dubai[1]

We, Mohammed
bin Rashid Al Maktoum, Ruler of Dubai,
After perusal of:
Law No. (17) of 2005 Establishing
the Roads and Transport Authority; and
Local Order No. (87) of 1993 Concerning
Calculation of the Costs of Repaving Roads and Repairing Damage Resulting from Accidents
and its amendments; and the resolutions issued in implementation thereof,
Do hereby
issue this Regulation.
The following words and expressions will have the meaning indicated opposite each of them unless the
context implies otherwise:

Emirate: |
The Emirate of Dubai. |
|
RTA: |
The Roads and Transport Authority. |
|
Executive Director: |
The executive director of the RTA. |
|
Road: |
Any public way on which traffic movement is allowed,
including main roads, side roads, and byroads; streets; public squares;
bridges; tunnels; interchanges; road median strips; public car parks;
pavements; pedestrian crossings; navigable canals; and quays. |

Road Elements: |
All essential or decorative materials and equipment forming
a Road, including pavements, tiles, asphalt, barriers, fences, lamp posts,
distribution boards and their appurtenances, metal poles and their fittings,
traffic lights, sign boards, warning signs, benches, sunshades, fountains, models, and other materials
and equipment. This also includes elements of the infrastructure of bridges
and tunnels and their structural, electrical, and mechanical components. |

Accident: |
An
act that causes damage to a Road or to a Road Element, including traffic
accidents and other accidents resulting from performing construction works, connecting
services, or performing any other intentional or unintentional acts. |
The costs of
repairing a Road or a Road Element affected by an Accident which occurs in the
Emirate will be calculated by the RTA in accordance with the standards and
rules it determines. However, these costs must cover:
1.
where the RTA uses its own resources to
repair the damage, the wages of workers, and the cost of machinery, equipment,
and raw materials to be used for repairing the damage; or
2.
the value of the agreement concluded between
the RTA and any of its approved contractors for repairing the damage, plus the
fees of the consultant who will supervise the implementation of such agreement.
The costs of
repairing a Road or a Road Element, plus twenty-five percent (25%) of these
costs as administration and supervision fees, will be collected from the person
who causes an Accident.
For the
purpose of implementing the provisions of this Regulation and the resolutions
issued in implementation hereof, the RTA may seek assistance from Government
departments and corporations in the Emirate.
The Chairman
of the Board of Directors and Executive Director of the RTA will issue the resolutions
required for the implementation of the provisions of this Regulation.
Local Order No. (87) of 1993 Concerning Calculation of the Costs
of Repaving Roads and Repairing Damage Resulting from Accidents and its
amendments are hereby repealed. Any provision in any
other legislation will also be repealed to the extent that it contradicts the
provisions of this Regulation.
This Regulation
will be published in the Official Gazette, and will come into force on the day
on which it is published.
