Concerning

Public Health and Community Safety in the

 Emirate of Dubai[1]

We, Hamdan bin Rashid Al Maktoum, Deputy Ruler of Dubai, Chairman of the Dubai Municipality,

After perusal of:

The powers legally vested in Us pursuant to the Order Establishing the Dubai Municipality;

The public health and safety, and environment protection legislation issued by the Dubai Municipality; and

The presentation of the Director General of the Dubai Municipality, and

For the purpose of achieving the public interest,

Do hereby issue this Order.

Article (1)

This Order will be cited as “Local Order No. (11) of 2003 Concerning Public Health and Community Safety in the Emirate of Dubai”, and will come into force on the date on which it is published in the Official Gazette.

Article (2)

In implementing the provisions of this Order, the following words and expressions will have the meaning indicated opposite each of them unless the context implies otherwise:

UAE:  

The United Arab Emirates.

Emirate:

The Emirate of Dubai.

DM:   

The Dubai Municipality.

Director General:

The director general of the DM.

Competent Department:

The Public Health Department and the Environment Department of the DM, each within its own powers.

Concerned Organisational Unit:         

Any department, section, division, office, or other organisational unit at the DM concerned with the implementation of the provisions of this Order.

Concerned Entity:              

Any ministry, or federal or local department, authority, or corporation in the Emirate, which is concerned with the implementation of the provisions of this Order.

Person:                  

A natural person or a public or private legal person.

Owner:

 

A Person in whose name a land plot, Building, corporation, Establishment, machine, vehicle, or merchandise is registered in his capacity as an owner or a possessor, or his legal representative.

Contractor:             

A Person who is assigned to implement construction works and who is licensed to conduct construction contracting activities in accordance with the legislation in force in the Emirate.

Occupant:     

A Person who has full operational control over a site (a land plot, Building, or any part thereof) in his capacity as an Owner, tenant, possessor, or in any other capacity that entitles him to fully occupy that site.

Building:                          

 

Any structure that is designated for residential purposes or for conducting a commercial, industrial, or other activity. This includes completed buildings and those under construction.

Public Place:            

A road, street, yard, pathway, pavement, vacant land plot, public square, public park, common area of a Building, and any other similar place.

Establishment:

A place where a Person conducts a commercial, tourist, industrial, or any other activity authorised in the Emirate.

Public Health:          

         

Maintaining community health, preventing disease, and enhancing the mental, physical, and psychological well-being of individuals through coordinated collective efforts. This includes ensuring environmental cleanliness, controlling Communicable Diseases, controlling pests, overseeing food safety, monitoring Public Health-related Establishments, and taking the necessary actions to safeguard and improve community health.

Health Hazard:

Any activity or process which may compromise Public Health, human safety, or the surrounding environment.

Smoking:               

The act of inhaling smoke produced by the burning of tobacco or any of its by-products, whether through a cigarette, shisha (hookah), pipe, or any other method.

Waste:

The liquid or solid refuse resulting from domestic, commercial, industrial, or agricultural activities; or any other materials classified as waste by the DM and discharged into the sewerage network or Landfills.

Landfill:                  

A site designated or approved by the DM for the final disposal or treatment of Waste.

Wastewater:           

Waste in liquid or semi-liquid form, mixed with suspended solids, resulting from domestic or similar uses.

Foodstuff:              

Any matter or ingredient intended for human consumption. This includes all types of food, beverages, and chewable substances, excluding water, medicines, and ingredients used in the processing, preparation, or composition of food items.

Healthy Food:         

All food items that have been enriched with beneficial supplements such as vitamins, proteins, minerals, and salts to provide the human body with the essential energy for replenishment, without causing Health Hazards.

Food Additives:

Any substance that is added to food for the purpose of changing its colour, improving its taste or flavour, preserving it, maintaining its consistency, or processing it; or for any other purpose permitted in food processing, preparation, or packaging, and that becomes a key component of the food item.

Food Label:

The information that is written, printed, photographed, engraved, or affixed on the Foodstuff package and that provides all relevant information, such as name, type, ingredients, production date, expiry date, country of origin, and storage instructions.

Adulterated Food:    

 

Food to which low-quality substances resembling its original components are added, causing a loss of its nutritional value, without disclosure on the Food Label.

Paan:           

 

Chewable betel leaves of any known variety, prepared with a combination of natural and chemical ingredients that compromise human health and the environment.

Standard Specifications:

The Foodstuff standards approved at local, GCC, Arab, or international levels concerning the nutritive, physical, chemical, and biological properties, as well as the ingredients, purity and impurity levels, and additives.

Food Establishment: 

An establishment licensed to conduct the activity of importing, exporting, and Dealing in Foodstuffs in the Emirate.

 Dealing in:

The preparation, processing, manufacturing, storage, packaging, retailing, transporting, distribution, display, and sale of products or commodities.

Food Contamination:

Any change in the properties of Foodstuff resulting from natural factors or human activities that poses a hazard to human health or safety.

Healthcare Establishment:             

A private Establishment that conducts the activity of providing patients with medical treatment, diagnostic services, or therapeutic services.

Public Health-related Establishment:

An Establishment that conducts activities directly related to human health and the requirements of natural living conditions.

Animal Production Establishment:

An Establishment that operates in the field of rearing or propagation of poultry, livestock, cattle, camels, and other animals and birds, as well as the production of meat, dairy products, eggs, and similar products. This includes trading in animals and livestock markets.

Animal Supplies Establishment:

An Establishment that operates in the field of Dealing in and importing animal feed, medicines, equipment, tools, and machinery used in animal production.

Stray Animals:

Animals that are abandoned by their owners in Public Places or in populated areas without care or attention.

Animal Keeper:

A person who has actual control over an animal, including its supervision, guidance, and management, whether as an owner, beneficiary, user, or in any other capacity.

Animal Disease:

Any disease, whether infectious or non-infectious, that affects an animal by harming its health, causing its death, or rendering it unfit for human consumption.

Zoonosis:     

A disease that affects animals and that can be transmitted from animals to humans.

 Veterinary Quarantine:                 

                  

The precautionary measures taken in respect of a group of animals coming from an area affected by an infectious Animal Disease or a Zoonosis. These measures include placing these animals under observation for a period equal to the incubation period of the disease, to verify that these animals are free from this disease or to detect any infected animal.

Communicable Disease:

A disease that can be transmitted directly or indirectly from an infected individual (dead or alive) to a healthy individual.

Quarantine:            

The practice of placing an infected individual in isolation for the duration of his infection to prevent spread of the disease.

Public Health Pests:

Any organisms that may harm humans or animals; serve as pathogen vectors or hosts, or transmitters; or cause inconvenience to humans or destroy their property. These include insects, spiders, and rodents.

Pesticides:                        

A substance or mixture of chemical or organic substances that is used to control Public Health Pests by eradicating them or reducing their activity.

Practice Guide:

A document approved by the Competent Department that contains the administrative requirements and operating standards for conducting various activities, aimed at ensuring human health and safety.

Children’s Toys:                

Any product or substance that is designed for children to play with.

Children’s Toys Basic Safety Requirements:

The safety requirements approved based on the European standard (EN71) for Children’s Toys and any other similar standards.

Entertainment Venue:

A place visited by people for entertainment, leisure, or amusement purposes. This includes function rooms; cinemas; clubs; or the venues of concerts, sports events, circuses, play halls, or outdoor ceremonies.

Entertainment Equipment:   

Any equipment or devices used for entertainment or leisure activities.

Swimming Pool

Any pool designed and constructed for swimming or bathing.

Private Swimming Pool:

A Swimming Pool located in private residential villas.

Public Swimming Pool:        

A shared Swimming Pool located in private residential apartment or villa compounds or in clubs, hotels, or public parks.

Chapter One

Health Hazards

Article (3)

No Person may cause or create any Health Hazard in the Emirate. The Competent Department may take all required measures to prevent or eliminate such a hazard.

Article (4)

For the purposes of the preceding Article, the following activities and acts are deemed Health Hazards:

1.    dumping, disposing of, or leaving Waste, litter, garbage, and the like inside or around Food Establishments or Public Health-related Establishment, thereby allowing them to rot, compromise Public Health, or cause inconvenience to the public;

2.    rearing animals in residential or inhabited areas;

3.    owning or trading in diseased animals;

4.    allowing odours, sounds, smoke, vapours, dust, and Waste to emanate from a Building or Establishment, which may compromise Public Health;

5.    practising any profession, or conducting any trade or activity, that may compromise the health and safety of those involved in this profession, trade, or activity or those nearby; and

6.    conducting any other activity or act the Competent Department deems a Health Hazard.

Chapter Two

Food Safety

Article (5)

Subject to any other rules or requirements related to the licensing of Establishments or companies in the Emirate, the licensing or renewal of licence of Food Establishments will be subject to approval of the Competent Department.

Article (6)

Foodstuffs which are imported, exported, or Dealt in by Food Establishments in the Emirate will be subject to full health control and supervision by the Competent Department, as well as to the rules, standards, and requirements adopted in this respect.

Article (7)

Dealing in Adulterated Foodstuffs in the Emirate is hereby prohibited. A Foodstuff item will be deemed an Adulterated Food in any of the following cases:

1.     It does not meet the Standard Specifications.

2.    One of its ingredients is wholly or partly replaced by another substandard substance.

3.    It is mixed or blended with another substance that alters its nature and degrades its quality.

4.    One of its ingredients is wholly or partly removed in a manner that degrades its quality.

5.    Its expiry date is intentionally concealed in any manner whatsoever.

6.    It contains any harmless colouring or preserving substances or additives which are not stated in its Food Label.

7.    The details on its packaging or on its Food Label do not accurately reflect the actual ingredients, misleading the consumer or compromising his health.

8.    It is defrosted after being deep-frozen or vacuum-sealed with the intention of selling it as a fresh product.

9.    It is presented in any other similar manner that the Competent Department deems as Adulterated Food.

Article (8)

Dealing in Foodstuffs that are spoilt, perished, harmful to Public Health is prohibited in the Emirate. Foodstuffs will be deemed spoilt, perished, or harmful to Public Health in any of the following cases:

1.    They are contaminated with microbes, parasites, or toxic substances that may cause illness in humans.

2.    They are derived from diseased or deceased animals.

3.    They contain too many impurities to be purified.

4.    Their packaging or wrapping contains substances that compromise health.

5.    Their composition or natural properties are altered in terms of taste, smell, appearance due to chemical or microbial decomposition.

6.    They contain partially or wholly perished plant or animal food matter whether they are processed or raw.

7.    They are expired as indicated by the expiry dates written, printed, or engraved on the packaging or Food Labels.

8.    They contain insects at any stage of their life cycle or animal waste.

9.    Foodstuffs presented in any other similar manner that the Competent Department deems to be spoilt, perished, or harmful to Public Health.

Article (9)

Foodstuffs produced, processed, or preserved using modern technology, or those to which Food Additives are added may not be imported, exported, or Dealt in without first obtaining the relevant authorisation from the Competent Department.

Article (10)

No packed or canned Foodstuffs may be Dealt in within the Emirate unless they meet the Food Label requirements adopted in this respect.

Article (11)

No shipment of Foodstuffs may be brought into the Emirate through sea, air, or land ports unless it is accompanied by the health documents and certificates approved in the country of origin, as well as the Halal certificates proving that the slaughter has been carried out in accordance with Islamic Sharia principles.

The Competent Department may seize the shipment in the absence of these documents and certificates until they are provided.

Article (12)

The Competent Department will issue the necessary resolutions to prohibit Dealing in, or to recall, destroy, or re-export, at the expense of the Owner, any Foodstuffs that are proven to have failed to meet the Standard Specifications or the health and Halal requirements, rules, and standards approved by the Competent Department in this respect, or that are proven through laboratory tests to be unfit for human consumption.

The Competent Department may take samples from any Foodstuff that is imported or Dealt in locally for the purposes of conducting laboratory tests to verify its validity and compliance with the aforementioned specifications, requirements, and rules.

Article (13)

No Person may be engaged in Dealing in Foodstuffs in the Emirate unless he is medically fit. Medical fitness must be confirmed by a valid occupational health card issued by the Competent Department.

Article (14)

Dealing in Foodstuffs in the Emirate must be subject to the relevant environmental and health requirements approved by the Competent Department. Dealing in frozen Foodstuff will not be allowed if the Dealing in process and conditions involve the risk of defrosting due to high temperatures and consequent Foodstuff Contamination.

Article (15)

Concerned Healthcare Establishments must report to the Competent Department any detected case of food poisoning to enable the Competent Department to identify the source of contamination that led to the incident, and to take the necessary action to address the consequences of the incident and prevent recurrence.

Article (16)

The Competent Department will determine the health conditions and circumstances, prohibited areas, and authorised locations for the sale of Foodstuffs, as well as the methods for Dealing in them.

Article (17)

The Competent Department may authorise Food Establishments and Animal Supplies Establishments to temporarily bring shipments of Foodstuffs and animal feed into the Emirate, after payment of the financial guarantees prescribed by this Order, pending the final results of their laboratory tests, their re-export, their destruction, or their transit to another location through the territory of the Emirate.

Article (18)

For the purposes of this Order:

1.    A Food Safety Committee is hereby formed in the DM. The members, duties, functions, and terms of reference of this committee will be determined pursuant to a resolution of the Director General.

2.    The Dubai Central Laboratory of the DM is designated as the official accredited entity in the Emirate for inspecting, analysing, and testing imported, exported, and Dealt in Foodstuffs to verify their validity and compliance with the Standard Specifications.

Article (19)

The implementing bylaw of this Order will determine the health and technical specifications, requirements, rules, standards, and conditions required to ensure the health and safety of Foodstuffs in the following areas:

1.    importing, exporting, and Dealing in Foodstuffs;

2.    Foodstuff safety and fitness for human consumption;

3.    determining and approving expiry dates and storage conditions for Foodstuffs;

4.    Food Labels;

5.    permitted and prohibited types of Food Additives;

6.    the temporary bringing into the Emirate of Foodstuffs that do not meet health requirements, and the prescription of the required relevant guarantees;

7.    the destruction of Foodstuffs that dot not meet the Standard Specifications or that do not comply with the approved food health and safety standards and requirements;

8.    determining the bases and procedures for collecting, examining, and testing of Foodstuff samples;

9.    evaluating the local food industry;

10.  licensing Food Establishments and those engaged in importing, exporting, and Dealing in Foodstuffs;

11.  expired health cards of those engaged in Dealing in Foodstuffs;

12.  inspecting and monitoring Food Establishments and verifying their compliance with the adopted standards, requirements, and rules;

13.  slaughtering livestock and poultry, and the transport, storage, marketing, packaging, chilling, and freezing of meat and fish;

14.  health requirements for the safety of Food Establishments, including abattoirs, slaughterhouses, and meat processing facilities;

15.  approval of food training programmes and certificates offered by training establishments; and

16.  approval of food control and Health Hazard management programmes and of the certificates awarded in this field.

Chapter Three

Drinking Water

Article (20)

Without prejudice to the powers vested in the concerned entities, the Competent Department will be responsible for monitoring and inspecting drinking water sources, stations, treatment plants, as well as reservoirs used for drinking water collection and distribution in the Emirate. For these purposes, the Competent Department may collect the necessary water samples for conducting the required laboratory tests to ensure the water is safe for drinking and complies with the adopted specifications and standards.

Article (21)

The drinking water distributed through the public water network, as well as bottled water, will be subject to the Standard Specifications adopted in the Emirate and to the standards of the World Health Organisation (WHO) in respect of drinking water quality.

Article (22)

The Competent Department may coordinate and cooperate with the concerned entities in the Emirate and with Concerned Organisational Units within the DM to determine the health and technical requirements for the safety and efficiency of the water systems and pipelines connected to storage tanks designated for drinking water.

Article (23)

An Occupant is responsible for the cleanliness and safety of drinking water tanks in his Building and for ensuring that the efficiency of all water distribution points within it.

Article (24)

Where the Competent Department discovers that drinking water is contaminated or unfit for human consumption, it must issue the necessary resolutions to prohibit its use and take the necessary action to prevent harm to Public Health. This includes requiring Occupants to implement the necessary measures to ensure uninterrupted flow of potable water.

Article (25)

No Person may establish a desalination, or a water purification and bottling plant for drinking purposes in the Emirate without first obtaining the relevant authorisation from the Competent Department and complying with the health requirements and quality standards adopted in this respect.

Chapter Four

Healthcare Establishments and Public Health-related Establishments

Article (26)

The Competent Department will have the duties of monitoring and inspecting all Healthcare Establishments and Public Health-related Establishments operating in the Emirate and listed in Schedule (1) and Schedule (2) attached to this Order and approved by Us, as well as all persons working in these establishments.

The Director General may, upon the recommendation of the Competent Department, add any other establishments to those referred to in this Article.

Article (27)

No Public Health-related Establishment may conduct its activities in the Emirate without first obtaining the relevant authorisation from the Competent Department.

In conducting its activities, a Public Health-related Establishment must comply the health, technical, and regulatory controls and requirements prescribed by the legislation in force in the Emirate and by the Competent Department.

The implementing bylaw of this Order will determine the documents that must be submitted and the procedures that must be followed for issuance of this authorisation.

Article (28)

All those working in Public Health-related Establishments will be subject to health control in accordance with the conditions, rules, and requirements prescribed by the Competent Department, including obtaining the mandatory occupational health cards certifying that they are free from Communicable Diseases.

Article (29)

Pharmacies licensed and operating in the Emirate must observe the rota schedules prepared by the Competent Department based on the areas where those pharmacies are located and population density.

Article (30)

Where an establishment which is subject to this Chapter fails to meet the adopted health and technical rules and requirements, the Competent Department may take all necessary actions to remedy the act of the establishment in a manner that prevents compromising Public Health.

Chapter Five

Communicable Disease Control

Article (31)

The Competent Department will, in coordination and cooperation with the concerned entities in the Emirate, develop the procedures required for controlling Communicable Diseases and epidemics in the Emirate; and establish the preventive and therapeutic requirements and measures, including quarantining and monitoring patients and implementing vaccination and sterilisation programmes where required.

Article (32)

The diseases listed in Schedule (3) attached to this Order and approved by Us are Communicable Diseases that must be reported to the DM as soon as detected or suspected by the Healthcare Establishments mentioned in items (1) and (2) of Schedule (1) attached to this Order.

The Director General may, upon the recommendation of the Competent Department, add to the list of diseases stated in the above-mentioned Schedule (3).

Article (33)

Where a resident in the Emirate who is not a UAE national contracts any of the diseases listed in Schedule (4) attached to this Order and approved by Us, the Competent Department must, in coordination with the concerned entities, take all the necessary actions to quarantine and deport him out of the UAE.

Article (34)

For the purpose of diagnosing Communicable Diseases, the Competent Department will, in coordination with the concerned entities, conduct the necessary medical laboratory tests for persons entering the Emirate and grant them medical certificates for the purpose of obtaining or renewing residence permits.

Article (35)

The Competent Department is the entity responsible and authorised in the Emirate to issue professional health cards for those working at Public Health-related Establishments after conducting the necessary medical and laboratory tests and confirming that they are free from Communicable Diseases.

Chapter Six

Public Health Pest Control

Article (36)

The Competent Department will undertake the Public Health Pest control duties and responsibilities in the Emirate. For this purpose, it will have the authority to:

1.    provide integrated Public Health Pest control services using environmental, chemical, or biological methods;

2.    oversee and supervise Public Health Pest control operations and Dealing in Pesticides; and

3.    evaluate and accredit companies and establishments operating in the field of Public Health Pest control, and approve their licensing.

Article (37)

No Person may engage in Public Health Pest control activities, nor may he import or Deal in Pesticides in the Emirate unless:

1.     he obtains the relevant authorisation from the Competent Department; and

2.     the Pesticides conform to the specifications adopted by the Competent Department.

The Competent Department will prescribe the technical, health, and environmental rules, standards, conditions, and requirements for regulating Dealing in, testing, and using Pesticides; and for preventing any associated hazards.

Article (38)

An Owner or a Contractor will, throughout the duration of the construction works, be responsible for Public Health Pest control; for preventing pest infestation in the Building, water tanks, and sewers; and for ensuring that the Building and its appurtenances are free from pests upon completion of the construction works.

Without prejudice to the Owner’s responsibility for the structures of a Building that remain standing after the completion of the construction works, the Occupant will be responsible for Public Health Pest control in that part of the Building he occupies.

Article (39)

No person may be engaged to work in Public Health Pest control unless he is technically qualified, medically fit, and duly authorised by the Competent Department.

Article (40)

The Competent Department will take all necessary preventative measures to control Public Health Pests and stop their infestation. These measures include:

1.    seizing the goods contaminated with Public Health Pests and closing down the premises where they are stored until they are treated, destroyed, or re-exported at the expense of the violator; and

2.    inspecting maritime vessels to ensure they are free from Public Health Pests, and requiring the Owners of infested vessels to control such pests.

Chapter Seven

Public Safety

Article (41)

It is prohibited to import, export, or Dealt in any material or commodity intended for human use, entertainment, or education if:

1.    it does not conform to the Public Health requirements adopted by the Competent Department;

2.     it poses a Public Health Hazard or safety hazard; or

3.    it features any inscriptions, images, figures, or other expressions that conflict with public order and morality, or the prevailing customs and traditions of the UAE.

Where any of the above occurs, the Competent Department may require the Owner of the material or commodity to re-export or destroy it at his own expense.

Article (42)

For purposes of the preceding Article, the Competent Department may have the necessary tests and investigations conducted on the materials and commodities at any specialised entity, within or outside of the Emirate, at the expense of the Owner to ensure they do not pose a Public Health Hazard or public safety hazard. To this end, it may also require any data or information concerning their ingredients, components, or method of use.

Article (43)

The Competent Department will adopt the Practice Guides approved by the DM for Public Health, safety, and the environment as principal guidance for the safe operation of all machinery, tools, equipment, and other work methods in the Emirate, with the aim of protecting their users and the public in general.

Article (44)

The Competent Department may require any Person Dealing in Children’s Toys to comply with the basic safety requirements adopted by it. To this end, it may prohibit or restrict the import or Dealing in any Children’s Toys into the Emirate, require their Owners to re-export or destroy them at their own expenses if they conflict with public order and morality, do not conform to the approved basic safety requirements, pose a health and safety hazard for children as proven by tests and experiments, or are not accompanied by a certificate of conformity with the basic safety specifications and requirements approved by the Competent Department.

The implementing bylaw of this Order will prescribe the basic specifications and requirements for ensuring the safety of Children’s Toys.

Article (45)

Entertainment Venues and other places frequented by the public must meet all Public Health and safety requirements. Occupants of these places and venues must comply with these requirements to ensure their safe operation without endangering the lives or safety of their patrons or neighbouring individuals.

The implementing bylaw of this Order will prescribe the Public Health and safety requirements that must be met by these places and venues.

Article (46)

The Competent Department may take all necessary actions against violators of the public safety requirements stipulated in this Chapter. For this purpose, it may close down violating Entertainment Venues and places, and prohibit the use of Entertainment Equipment that may pose a safety hazard for users.

Article (47)

No Swimming Pool may be constructed in the Emirate without first obtaining the Competent Department’s approval of the pool’s plans and designs.

Except for Private Swimming Pools, a Contractor must obtain a certificate from the Competent Department confirming the pool’s suitability for operation upon completion.

Article (48)

An Occupant is responsible for ensuring that a Public Swimming Pool meets the health and safety requirements. This includes providing equipment to ensure the safety of pool users, appointing a full-time qualified lifeguard, and performing regular maintenance.

Article (49)

The Director General may, upon the recommendation of the Competent Department, issue a resolution closing a Public Swimming Pool in any of the following cases:

1.    Where the Public Swimming Pool is in a condition that may compromise the health of its users and the Occupant has not taken action to remedy the situation within the notice period granted to him by the Competent Department.

2.    Where there is an outbreak of a Communicable Disease that is transmittable through water. In this case, the Public Swimming Pool will remain closed until a resolution is issued by the concerned entities confirming that the Emirate is free from this disease.

Chapter Eight

Smoking Control

Article (50)

The importation, manufacture, or sale of any type of tobacco in the Emirate is prohibited if it contains additives that are harmful to health or the brain.

Additives that are harmful to health or the brain include any chemical or natural substances that affect the human brain or nervous system.

Article (51)

For the purpose of protecting Public Health in the Emirate, the Competent Department may establish the necessary controls and requirements to prohibit Smoking in the following Public Places:

1.    means of individual and mass transport;

2.    shopping centres and Entertainment Venues; and

3.    restaurants and cafes.

The Competent Department may also restrict Smoking in any other places where it deems that it may harm non-smokers, lead to passive Smoking, or serve as a means of influencing the behaviour of minors by encouraging them to smoke.

Article (52)

The sale of tobacco in all its forms is prohibited in the Emirate to any person who appears to be under the age of twenty-one (21) years.

Chapter Nine

Health and Safety of Buildings

Article (53)

The expression “Health and Safety of Buildings” refers to Buildings conformity to the health and environmental standards, and safety requirements that are necessary for their appropriate use, ensuring the protection of the health and safety of residents, and maintaining their internal environments and surrounding environments. This includes construction materials, drinking water, sewerage systems, air conditioning systems, elevators, emergency exits, fire-fighting systems, indoor air quality, and common facilities.

Article (54)

The health and environmental standards and requirements adopted by the DM will apply to the Health and Safety of Buildings in the Emirate.

The implementing bylaw of this Order will determine such standards and requirements.

Article (55)

The Competent Department may, in coordination with the Concerned Organisational Units, conduct tests, inspections, calibrations, and evaluations of the systems and services referred to in Article (53) of this Order to verify their efficiency and functionality, and to ensure that they do not compromise Public Health and safety. It may also take the necessary actions to require the Occupant to remedy any violations, if present.

Article (56)

An Occupant must ensure healthy indoor air quality in the Building by:

1.    providing the appropriate means for venting gaseous emissions, air pollutants, and heat produced by various activities and facilities within the Building;

2.    ventilating the indoor air of the Building in accordance with the approved standards for indoor air quality; and

3.    ensuring that the acceptable levels of indoor air quality are not exceeded and striving to maintain these levels.

Article (57)

The Competent Department, in coordination with the Concerned Organisational Units, will issue occupancy permits for shared accommodation Buildings in accordance with the health and environmental requirements and standards, and the safety requirements, prescribed by the implementing bylaw of this Order.

The Competent Department may disconnect utilities, close down the Building, and revoke the permit in the event of non-compliance with these conditions and requirements.

Article (58)

The Occupant must conduct maintenance of the Building on a regular basis to ensure ongoing compliance with the Public Health and safety conditions and requirements.

The implementing bylaw of this Order will prescribe these conditions and requirements.

Chapter Ten

Public Cleanliness

Article (59)

It is prohibited to dispose of, leave, place, spill, discharge, or leak any Waste in Public Places or in places other than those designated for this purpose, or contrary to the conditions and requirements approved by the Competent Department. In particular, the following is hereby prohibited:

1.    throwing Waste out of vehicles onto public roads;

2.    dropping any solid or liquid materials from vehicles onto public roads, or transporting dispersible materials in open vehicles without covering them;

3.    urinating or defecating in areas other than the facilities designated for this purpose, or spitting in Public Places;

4.    spitting and discarding Paan residue and waste in Public Places;

5.    disposing of construction or demolition debris or residues from technical or production processes of companies, factories, or establishments in locations other than the approved disposal sites;

6.    disposing of Wastewater in locations other than those approved by the Concerned Organisational Units;

7.    disposing of used oils in sewerage networks or cesspools, or spilling such oils on pavements or roads;

8.    disposing of oils and Waste from marine vessels in seawater, on beaches, in creek water, or in ports;

9.    dumping tree or garden Waste in locations other than those designated for this purpose by the Competent Department;

10.  discharging vehicle washing water in locations other than those designated for this purpose by the Competent Department;

11.  allowing air conditioner water or any other water to leak onto pavements or roads; and

12.  disposing of Wastes by open burning.

Article (60)

No goods, materials, or other items may be left, stored, placed, or hung in a Public Place; on a house roof; or on a balcony in a manner that obstructs road traffic; causes inconvenience to pedestrians; mars the general appearance and aesthetics of the Emirate, or the façades and balconies of Buildings; or breaches Public Health, safety, and environmental requirements.

Article (61)

The Occupant of a Building must:

1.    provide a room or space inside the Building where Waste containers are kept in accordance with the conditions and specifications determined by the Competent Department, including providing a means of delivery of Waste from the inside of the Building to the garbage room, emptying and returning these containers to their place, and maintaining them on a regular basis; and

2.    supervise management of the indoor cleanliness of the Building in accordance with Public Health and environmental rules.

Article (62)

Private companies and establishments, commercial and residential complexes, and hotel establishment must:

1.    provide containers for collecting Waste resulting from their activities in accordance with the relevant rules, conditions, and standards adopted by the Competent Department;

2.    replace Waste containers where it is established to the Competent Department that the amount of Waste resulting from their activities exceeds the capacity of existing Waste containers, or that the resulting Waste poses a danger to Public Health and the environment; and

3.    implement a plan for cleaning the public areas surrounding public and private car parks they use.

The Competent Department may require any of these entities to collect and store the Waste resulting from conducting their activities and to transport the same using their own vehicles or the vehicles of a company licensed to transport Waste to the Landfills designated by the Competent Department for this purpose or outsource.

Article (63)

No Person may be licensed to conduct the activity of collecting, storing, transporting, reusing, recycling, or treating any Waste produced by third parties; or to provide cleaning services in Public Places in the Emirate without first obtaining a permit from the Competent Department and satisfying the standards and conditions it prescribes for this purpose.

Article (64)

A Person must not:

1.    place any materials in a Waste container that may cause damage to the container or to the Waste transport vehicle; or pose a hazard to the health and safety of Persons involved in Waste collection, transportation, and disposal; or

2.    move or alter the location of a DM Waste container without the approval of the Competent Department, or tamper with its contents.

Article (65)

If it is established to the Competent Department that the activity conducted by a Person results in a large volume of Waste, the Competent Department may request this Person to prepare and implement a plan to reduce the volume of, or recycle, such Waste.

Article (66)

No Person may import, Deal in, acquire, possess, or consume Paan in the Emirate for personal use, or for the use of a third party with or without consideration.

This prohibition extends to betel leaves used in the manufacture and preparation of Paan.

Chapter Eleven

Animal Health and Care

Article (67)

An Animal Keeper is responsible for care and provision of the necessary veterinary preventive and therapeutic services for his animals. This includes to:

1.    provide suitable and clean shelter to the animals, ensuring that they are restrained in residential areas or in areas where animals are not permitted;

2.    have the animals regularly examined and tested to ensure they are free from Animal Diseases or Zoonoses;

3.    immunise the animals against Animal Diseases or Zoonoses, and obtain an immunisation card approved by the Competent Department; and

4.    notify the Competent Department immediately if the animals contract, or are suspected of contracting, an infectious Animal Disease or a Zoonosis, and taking appropriate action to quarantine or dispose of the animals in accordance with the relevant adopted procedures.

Article (68)

No livestock may be slaughtered for human consumption if it is infected or suspected to be infected with an Animal Disease or a Zoonosis.

For the purpose of ensuring the safety of livestock prior to slaughter, the Competent Department may:

1.    examine all livestock prior to slaughter;

2.    euthanise or quarantine any infected livestock where it is established that it poses a danger to Public Health; or

3.    dispose of meat if, after slaughter, it is determined that the livestock is infected with a disease that renders is unfit for human consumption.

4.    In implementing the provisions of this Article, the DM will not be liable for compensating any Person for any livestock or carcass, or any part thereof, that is discarded in any of the above-mentioned cases.

Article (69)

Subject to any instructions or directives stipulated in the applicable legislation, the Competent Department will issue the veterinary and technical instructions or directives required for protecting animal-related production and care for livestock in the Emirate, particularly in the following areas:

1.    the husbandry and care of animals kept for the production of milk, eggs, and meat;

2.    the identification of Animal Diseases and Zoonoses and updating animal owners regarding modes of transmission and prevention, as well as the procedures that must be followed in the event of infection; and

3.    the determination of Veterinary Quarantine procedures for imported animals, as well as the isolation of infected animals and those suspected of being infected with any of the diseases referred to in paragraph (2) of this Article.

Article (70)

The Competent Department may detain lost animals in sheds designated for this purpose. If owners of these animals fail to claim them within one (1) week from the date of their capture, the animals will be deemed Stray Animals and will be forfeited to the DM, which will then be entitled to sell them at public auction or to slaughter them and sell their meat at the prevailing market prices.

The implementing bylaw of this Order will determine the procedures and the provisions concerning the detention of lost animals in designated sheds.

Article (71)

A fine of one hundred and fifty dirhams (AED 150.00) will be imposed on animal owners for each lost animal captured by the DM, payable when they submit a request to reclaim their animals.

Article (72)

Abattoirs and other Establishments licensed to slaughter livestock and process meat in the Emirate will be subject to direct health control and supervision by the Competent Department to ensure the health and safety of meat and its suitability for human consumption. For this purpose, the following is prohibited:

1.    slaughtering any animal outside of the abattoirs or the Establishments licensed by the Competent Department, whether for commercial purposes or for domestic consumption; and

2.    forging or imitating DM abattoir meat stamps, or affixing such stamps on imported carcasses or on meat from animals slaughtered outside the abattoirs or the Establishments licensed by the Competent Department.

The implementing bylaw of this Order will establish the rules and standards to ensure that the abattoirs and Establishments licensed by the Competent Department comply with the necessary health requirements.

Article (73)

The Competent Department will determine the materials that are permitted to be used for cleaning and disinfecting the entrails of carcasses destined for human consumption or as animal feed.

Any Person who uses or attempts to use unauthorised materials will be deemed to have committed a violation, and will be subject to the penalties prescribed in this Order.

Article (74)

The licensing of Animal Supplies Establishments, Animal Production Establishments, and shops located within animal markets in the Emirate will be subject to approval of the Competent Department. In conducting their activities, these establishments will also be subject to control and inspection by the Competent Department to verify their compliance with the technical and health conditions and requirements prescribed by the implementing bylaw of this Order.

Article (75)

The sale and processing of carcasses or their parts that are not fit for human consumption and are used as animal feed, as well as the storage and disposal of carcass remains, will be subject to the relevant standards, rules, and requirements determined by the Competent Department.

Article (76)

Transportation of meat and the by-products of carcasses processed at abattoirs will be subject to the requirements and standards stipulated in the implementing bylaw of this Order.

By-products of carcasses include: all parts of a carcass other than meat, including the head, legs, stomach, liver, kidneys, heart, spleen, and intestines of the slaughtered animal.

Article (77)

Companies and establishments operating in the field of import, export, and sale of animals, including pets, birds, and ornamental fish, as well as in the field of manufacturing and sale of animal feed, must comply with the requirements and standards stipulated in the implementing bylaw of this Order.

The Competent Department will have the authority to inspect these entities to ensure their compliance with these requirements and standards.

Article (78)

The Competent Department must verify that all those working at Animal Production Establishments and Animal Supplies Establishments have obtained their professional health cards from the Competent Department. These cards confirm that their holders are free from any Communicable Disease or Zoonoses, and that they undergo periodic medical examinations.

Article (79)

Without prejudice to the provisions of Article (67) of this Order, a keeper of any cat or dog must register it with the Competent Department and place an identification collar around its neck.

The Competent Department may dispose of a lost dog or cat that does not have the above-mentioned identification collar. If the animal does have an identification collar, the Competent Department may detain it and notify its keeper to collect it within three (3) days upon payment of the prescribed fine, otherwise the DM may dispose of the animal in any manner it deems appropriate, without incurring any liability or legal consequences as a result.

Article (80)

It is prohibited to bring dogs into beaches and public parks. Dogs must also be on a collar and leash when walked in any Public Place.

Article (81)

No animal may be brought into the Emirate unless it is accompanied by a certificate from the country of origin confirming that it is immunised against and free from Animal Diseases or Zoonoses. Where necessary, the Competent Department must take all preventive measures in respect of such animals, including Veterinary Quarantine measures.

Article (82)

The Competent Department will issue the veterinary health certificates, permits, and reports in respect of all matters related to this Chapter.

Chapter Twelve

Burial Services and Cemetery Supervision

Article (83)

The DM will construct, regulate, and protect cemeteries in the Emirate; and will provide comprehensive humanitarian burial services in coordination and cooperation with the concerned entities in the Emirate.

Article (84)

No deceased individual may be buried in the cemeteries of the Emirate unless he held a valid residence permit, and a burial permit has been obtained from the Competent Department and the concerned entities.

However, the Competent Department may, in certain cases, grant exemptions from the residence requirement stipulated above.

Article (85)

Burials will be conducted in accordance with the provisions of Islamic Sharia and the religious rites of the relevant sect, as applicable.

The implementing bylaw of this Order will determine the health and environmental requirements for burials, and the rules governing the transportation of bodies into and out of the Emirate.

Chapter Thirteen

Violations and Penalties

Article (86)

Without prejudice to any stricter penalty stipulated in any other legislation, a Person who violates the provisions of this Order, its implementing bylaw, or the resolutions or instructions issued in pursuance hereof will be punished by a fine of not less than one hundred dirhams (AED 100.00) and not more than five hundred thousand dirhams (AED 500,000.00). Upon repetition of the same violation within one (1) year from the date of the previous violation, the amount of the fine will be doubled, but may not exceed the maximum fine amount.

The Competent Department, in coordination with the concerned entities, may take one or more of the following measures against a violating entity:

1.    suspend or revoke the permit or licence to conduct the activity for a period not exceeding one (1) month;

2.    disconnect water and electricity services to the violating Building, Establishment, or corporation for a period not exceeding three (3) months;

3.    confiscate or destroy the goods, products, or materials that do not comply with the approved health and environmental requirements; and/or

4.    impound vehicles that do not conform to the environmental rules and public cleanliness stipulated in this Order.

The implementing bylaw of this Order will determine the acts that constitute violations of its provisions and the penalties prescribed for each violation.

Article (87)

The employees and inspectors of the DM nominated by the Director General will have the capacity of law enforcement officers to record the acts committed in breach of the provisions of this Order, its implementing bylaw, and the resolutions issued in pursuance hereof. For this purpose, they may access the Buildings, Establishments, corporations, and sites governed by the provisions hereof; review their records and registers; identify and seize the violating goods, materials, tools, and equipment used in the commission of the violation and confiscate or refer them to the competent entity for examination and analysis; and prepare the necessary violation reports.

Article (88)

In addition to the penalties prescribed by this Order, a Person who, through his actions or negligence, violates this Order and causes harm to Public Health and safety or the environment is liable for remedying the harm or paying compensation for it.

Article (89)

If a violator fails to remedy a violation or the resulting harm within the time frame prescribed by the Competent Department, the department may take the necessary measures to remedy the violation and harm, and require the violator to pay the incurred costs, plus twenty-five percent (25%) of these costs as administrative fees.

Chapter Fourteen

Final Provisions

Article (90)

The fees set out in Schedules (5), (6), and (7) attached to this Order and approved by Us will be charged for the health and environmental services provided by the Competent Department.

Article (91)

Where the Competent Department decides to require private companies and corporations, commercial and residential complexes, and hotel establishments to collect, store, and transport the Wastes generated by their activities using their own vehicles, or those of licensed Waste transport companies, only twenty-five percent (25%) of the value of the public cleanliness service fees stated in items (8) and (11) of Schedule (6) attached to this Order will be collected.

Article (92)

The Competent Department will collect the security deposits set out in Schedule (8) attached to this Order and approved by Us for shipments of food, animal feed, or veterinary substances. These deposits are required for re-exporting such shipments to their country of origin, until laboratory test results are obtained, or until they are moved between warehouses within the Emirate or from other emirates to the Emirate, or from the Emirate to another emirate.

The security deposit will be confiscated, and the appropriate penalty imposed, where the Person who provides it violates any of his obligations under this Order, its implementing bylaw, or the instructions issued in pursuance hereof.

Article (93)

The fees and fines collected, and the security deposits confiscated, under this Order, its implementing bylaw, or the instructions issued in pursuance hereof will be paid to the DM.

Article (94)

For the purpose of implementing the provisions of this Order and the resolutions and instructions issued in pursuance hereof, the Competent Department may seek assistance from the Concerned Organisational Units of the DM and the Government departments and public authorities and corporations in the Emirate, including police personnel. These entities must, upon request, provide the DM with assistance as soon as practicable.

Article (95)

The local orders issued by the DM and set out in the list attached to this Order are hereby repealed.

The implementing bylaws and administrative resolutions issued in accordance with the repealed orders will continue in force, to the extent that they do not contradict this Order, until the implementing bylaw of this Order is issued.

Article (96)

The Director General will issue the resolutions and instructions required for the implementation of the provisions of this Order.

Article (97)

The Director General may delegate certain powers vested in him under this Order to any DM employee as he deems appropriate.
