Resolution No. (12) of 1998[1]

We, Hamdan
bin Rashid Al Maktoum, Chairman of the Dubai Municipality,
After perusal of:
The powers legally vested in Us pursuant
to the Order Establishing the Dubai Municipality; and
The presentation of the Director
General of the Dubai Municipality, and
In accordance with the exigencies
of public interest,
Do hereby
issue this Resolution.
It
is prohibited to cut or uproot, or commit any act that may cause damage to, any
plants or trees in public areas, squares, parks, and facilities in the Emirate
of Dubai.
In
particular, it is prohibited to cause damage to green landscape areas within public areas, squares, and
roads, whether by treading or lying on these areas or committing any act that
may impair their aesthetic appearance.
The
inspectors of the Dubai Municipality and police
personnel will have the capacity of law enforcement officers to record the acts
committed in breach of the provisions of this Resolution.
The
employees of the Dubai Municipality who have law
enforcement capacity as stipulated in the preceding Article may seek assistance
from police personnel in
performing their duties under this Resolution.
Without prejudice to any stricter penalty
stipulated in any other law, local order, or resolution, a person who violates
the provisions of this Resolution will be punished by a fine of no less than
five hundred dirhams (AED 500.00) and no more than one thousand dirhams (AED
1,000.00); and will be held liable for any
repair costs incurred.
The
fines collected pursuant to this Resolution will be paid to the Dubai
Municipality.
The
Director General of the Dubai Municipality will issue the instructions required
for the implementation of this Resolution.
This
Resolution comes into force on the day on which it is issued.
