Imposing a Labour Accommodation Fee in the Emirate of Dubai[1]

We, Hamdan
bin Rashid Al Maktoum, Chairman of the Dubai Municipality,
After perusal of:
The powers legally vested in Us
pursuant to the Order Establishing the Dubai Municipality;
The Dubai Municipality Revenue
Law promulgated by Dubai Municipality Council Resolution
No. (151) issued on 11 April 1962;
Resolution No. (15) issued on 11
April 1962;
The Resolution issued on 25 January
1989 by the Finance Committee and the General Purposes
Committee of the Dubai Municipal Council; and
The presentation of the Director
General of the Dubai Municipality, and
In accordance with the exigencies
of public interest,
Do hereby
issue this Order.
An
annual Labour Accommodation Fee is hereby imposed in respect of all labourers residing or working in the Emirate of Dubai.
For
the purpose of implementing this Order, the owner of an establishment licensed
to operate in the Emirate of Dubai will pay the Labour Accommodation Fee in respect of the labourers employed by him.
This fee will be collected in advance for each year of the term of the licence. The owner of the establishment may not have recourse
against his labourers for the said fee.
The
amount of the annual fee imposed hereunder will be determined as prescribed in
the Schedule attached to this Order. In all events, the amount of the fee paid
by an establishment for the accommodation of its labourers may not exceed two
hundred thousand dirhams (AED 200,000.00).
The
Resolution of the Finance Committee and the General Purposes Committee of the Dubai Municipal Council Concerning
Collecting a Flat Fee for Labour Accommodation of Contracting Companies, issued on 25 January 1989, is hereby
repealed. Any other orders or resolutions will also be repealed to the extent
that they contradict the provisions of this Order.
The
Director General of the Dubai Municipality will issue the resolutions and
instructions required for the implementation of this Order. In this respect, the
Director General of the Dubai Municipality may coordinate with the Government
departments, and the public authorities and corporations, in the Emirate of
Dubai.
This
Order comes into force on the first day of the month following the date on
which it is issued, and will be published in the Official Gazette.

calculating the fee payable for labourers in any slab, the fee prescribed under
the previous slabs will apply.
